A federal appeals court had ruled in favor of The Slants, but the Obama administration appealed to the Supreme Court.
The institute explained the background: Simon Shiao Tam is the front man for the band. He is of Asian descent and heritage and has said the name was chosen because he and the other members wanted to take on the stereotypes of Asians and own them.
He also said he is proud of the Asian heritage, and the response hes gotten to the bands name from the Asian community has been positive.
The government, however, said it was refusing permission to trademark the name because it consists of or comprises immoral, deceptive, or scandalous matter; or matter which may disparage or falsely suggest a connection with persons, living or dead, institutions, beliefs, or national symbols, or bring them into contempt, or disrepute.

FTR, I’m not a fan of either label, but I think the free market should decide these things, not Big Brother.

Pretty much what I was thinking - they should call themselves “SWA”, and throw it back at ‘em.

On the road, I avoid the slants. There is nothing more dangerous than road-mung. Penicillin is in your future.
I was a part of a band called A Pack of Crackers. No one was upset or threatened to sue us.
How many members in the band? If there are six, they can call themselves The Slant 6. That’s a Chrysler reference for the non-car-geeks among us.
Why is the government in this business? Slant would be allowed if the band was white. So it should be allowed if the band is Asian. Of course the band keeps its name. The question is whether it can claim its name as a Trademark. In other words. The government is saying everyone can use the name.
