That is a topic which has been examined in detail by many researchers, litigants, activists, vendors, commissions, and other parties. Some voting machines turned out to be poorly designed and capable of being reprogrammed with malicious code. Others, due to their design, would be much harder to attack, unless the attacker had undetected access to the machines.
Unfortunately, the worthwhile efforts to secure voting machines are getting mixed up with accusations made by the Stein campaign that are in tinfoil hat territory.
Some of the machines Stein contends could have been hacked by "Russians" or some other nefarious group, would require the hackers to have physical access to the machines in order to implement the software changes. It really stretches the imagination to think that either a group of ninja technicians broke into the voting machine warehouses and altered hundreds or thousands of machines (and perfectly replaced the security seals), or that the Democrat election officials in Pennsylvania were actually participating in some wild conspiracy to elect the Republican candidate.
When confronted with the actual circumstances Stein's experts fall back on complex conspiracy claims. You see, even though independent and party observers test a random sample of machines, how do you know that the election officials didn't remove the hacked code from those machines so they would pass the test? They had time between when they were given the numbers of the machines to be tested and when the tests were run! So they could have covered up the hacking.
The theories they are advancing are past speculative and into tinfoil hat territory. Where are Scully and Muldaur when you need them.
Anything versus bull would make me do a double take.
IIRC Clinton got away with a retro active tax. The Constitution specifically prohibits ex post facto law. The difference between law and tax is slender, but in fact it is a legitimate difference. So this Mi law could get by as a fee. The Constitutional prohibition was according to scholars intended to prevent a legal act from being criminalized after the fact. There is no question of criminality here, just a govt seeking to recoup what it spent on a fool’s errand. So I think this passes muster.
For us law types, Calder v. Bull is actually a very interesting case. It has all of the following:
1. Holding that the Constitutional prohibition against ex post facto laws does not apply to civil cases;
2. Holding that the United States Supreme Court does not have jurisdiction to interpret the Constitution of a State; the State Supreme Court is the highest authority (unless the State Constitution conflicts with the Federal);
3. Does not specifically state that the Court can declare an act of the Federal government unconstitutional, but infers that it can (this is prior to Marbury v. Madison);
4. In an opinion by Justice Chase, he stated that the Court had the authority to declare unconstitutional any act that was contrary to “natural law.” His language echoed the arguments of James Otis in the Writs of Assistance case in 1761. Thus was born the concepts of Judicial Activism and what became known as “Substantive Due Process,” or the judicial recognition of rights not specifically stated in the Bill of Rights;
5. An opinion by Justice Iredell rejected Chase’s analysis, saying that the Court could only declare unconstitutional an act if the act violated a specific provision of the Constitution. Iredell specifically rejected the natural rights approach because it was inherently subjective on the part of judges using it. Thus was born the concepts of original textualism and Judicial Restraint.
The debate between Judicial Activism and Judicial Restraint began less than a decade after the adoption of the Constitution, and has continued for over 200 years.

IF the left had been paying attention. IF the democrats had been paying attention. IF they had just paid attention instead of lying to themselves, and listening to what they wanted to hear...
They would have known they were in for a deafening defeat and obama was PAST HISTORY... and all he did was going to be undone by the PEOPLE of these UNITED STATES!

It will as long as someone like Trump is at the helm... this isn’t hard to do... it just takes someone who is not owned by the establishment and who isn’t afraid to stand firm and strong, in all the crap they throw out. I can’t think of another person who could do this... so Thank You God for sending ... President Elect Trump!

I’ve heard those small discs called floppy as well since the inside of them are floppy disks but I understand about the larger one being a floppy. The size reduction and increase capacity of memory chips are amazing.
Correct. They are very limited in their ability to apply an ex-post facto law.
