Following Donald Trump's victory an elector from a state the President-elect won says he's faced pressure, and even death threats, to change his decision in the Electoral College vote later this month. A youth vice-chairman of the Michigan Republican Party, Michael Banerian described to us the messages he received.

I have yet to see any so-called "threat" would be a prosecutable "true threat". Michael Banerian talked about the threat on TV for a couple of weeks before reporting it to police. Furthermore, Banerian says he isn't afraid of the threat. These factors are both strong evidence that Banerian did not receive a prosecutable "true threat".

A threat must intend to produce fear in order for it to be a "true threat" prosecutable by law. Telling a coworker that "I will kill you" when you find out that you've been the butt of a practical joke is not a "true threat". Likewise, Banerian's own actions show that he did not perceive the alleged threat to be a "true threat". He spent two weeks making political points about it on TV before reporting it to police. But the strongest evidence that the Banerian threat is not a "true threat" is that Banerian himself says he wasn't afraid of it.

Regarding Obama, Courts ruled that saying "Re: Obama fk the niggar (sic), he will have a 50 cal in the head soon" and "shoot the nig" is free speech. No crime committed at all.
