Will Obama pardon Clinton?

At a campaign rally in Novi, Michigan Friday evening, Donald Trump asked President Barack Obama not to "pardon Clinton and her co-conspirators" if any charges were filed related to the email scandal.

"Mr. President," Trump said. "Will you pledge not to issue a pardon to Hillary Clinton and her co-conspirators for their many crimes against our country, and against society itself. No one is above the law."

“He will be under tremendous, tremendous pressure by his party.....”...

Now that he has served his time as POTUS, what does he owe “his party”? He can abandon them just as easily as he has the entire country, put nothing past him. The only thing that he will need to worry about is his longevity, the Clinton’s do have ways of getting revenge.

He won’t need to pardon her (although he probably will).

She will never face justice, just as Robert E. Lee wasn’t hanged, and for the same reason.

If you really wanted to do something with consequences (on future generations)....then I’d skip Hillary, the emails, etc...and center on the Clinton Foundation.

I’d do a complete audit and line up the charges. I’d go after the dozen-odd people who run the foundation and seize a lot of their money to hold until matters get cleared up. At the end...when charges could come to Hillary....I (as Trump) would say that I’ll pardon you but you can’t ever run another foundation ever, for the rest of your life, and all money in the account has to be given to some real charity. I’d also insert a line that she can’t appear in any televised interview for at least a year.

Except he was a sitting President at the time of the impeachment. She holds no government position.

Democrats have more to gain with Bill and Hillary in prison. There would be protests and lots of attention, and then they would include a pardon in their platform in 2020.

You cannot Pardon someone for Treason until they are charged AND the jury has found the accused guilty.

Now, if Obama begins charges of Treason against Hillary and she is found guilty within 70 days; then yes. But those are long odds.

If The Donald has the dirt on Obama it will be a useful tool to dissuade Obama from granting a pardon. Then if he pardon’s her he will have to pardon himself. That’s what we deplorable’s call awkward.

By pardoning the Wicked Witch of Chappaqua, Obama would be admitting that she is a criminal and demonstrating that all her defenders are liars.

And wouldn’t pardoning her before that be a tacit admission of her guilt?

Some blogger was floating the theory that Comey didn’t charge her, because he knew Trump would win, and without a conviction Obama can’t pardon her, but Trump would be able to hold her to account. I don’t know if this holds any water.

Maybe. it makes sense to me.

Here’s the US Supreme Court’s opinion on that:

...The Constitution provides that the President “shall have power to grant reprieves and pardons for offences against the United States, except in cases of impeachment.”

The power thus conferred is unlimited, with the exception stated.

It extends to every [federal] offence known to the law, and may be exercised at any time after its commission, either before legal proceedings are taken or during their pendency or after conviction and judgment...

This power of the President is not subject to legislative control...

That is true, but Hillary is still just a private citizen, her going to jail won’t matter to the country, like if she were a President, I don’t know if that would make a difference.

The leading Supreme Court case is Ex parte Garland (1867). Justice Stephen J. Field, writing for the Court in a 5-4 decision, held that the President’s pardoning power is ‘’unlimited,’’ and ‘’It extends to every offense known to the law, and may be exercised at any time after its commission, either before legal proceedings are taken, or during their pendency, or after conviction and judgment.’’

Honestly, if he does it just codifies the corruption of the Democrat party. My preference would be an independent council but if she is pardoned, I am moving on. She leaves the scene and we have work to do.

Only if HIS “legacy” depends on it. That means that Hillary will have to have some serious dirt on Barry and threaten to use it if he refuses to give her a blanket pardon.
