Liberals, stop being so defensive. Thats the message of Harvard law professor Mark Tushnet in a new post at Balkinization, titled Abandoning Defensive Crouch Liberal Constitutionalism. The problem, according to Tushnet, is that liberals have been too defensive when it comes to advancing their agenda in the courts.
Tushnet blames what he calls the culture wars on conservatives, and he says liberals should now make conservatives pay. The culture wars are over; they lost, we won, he writes in italics. Tushnet claims that conservatives had opportunities to reach a cease fire, but rejected them in favor of a scorched earth policy.

I have an anecdote that demonstrates this.
A high school classmate is part of the gay scouting movement. A few years ago, he would post on Facebook about what racist, homophobic, wife beating Neanderthals the scouts were.
The scouts relented to this pressure, and allowed gay scouts but not gay leaders. Less than an hour after this major victory, he was back at it - calling the scouts racist, homophobic, wife beating Neanderthals because they wouldn’t accept gay leaders.
So, the scouts relented on this, and now allow gay leaders with one caveat - if a sponsoring church was against gay leaders, they could opt out. Still a major victory. But, because of the caveat, in less than an hour he was back at it, calling the scouts racist, homophobic, wife beating Neanderthals.
To me, this is a case study in how liberals operate. They are like a ratchet, and never give an inch - only move in one direction. There is no way to compromise. And, deep down inside, most liberals would just as soon kill a conservative, rather than have a ‘spirited debate’.

What you see is the Hegelian Dialectic being used.
The US term for it is incrementalism. Liberals call it progress.
From kindergarten to Harvard, with some jaunts into democrat/marxist politics along the way, it’s no wonder that any and everyone with a view dissimilar to his own is decried as a nazi.
As for discrimination, the university in general is among the most discriminating of all institutions. Those so associated are the elite. Everyone else is among the little people. Even those graduates no longer so associated.

Interesting. I’m familiar with the term incrementalism, but not the other. And the left has a knack for taking a word and twisting its meaning - who could be oppose to progress?
