A New York judge will hear arguments on Tuesday in a lawsuit that challenges Republican Sen. Ted Cruz’s ability to run for president given that he was born in Canada.
State Supreme Court Justice David Weinstein will hear the claim of two men who contend that Cruz is not a citizen of the U.S. and is therefore ineligible to run for president, NBC has reported. Cruz was born in Alberta, Canada.
Barry Korman and William Gallo will argue that despite Cruz’s mother being an American, the senator is not a citizen because such status cannot be passed from parent to child, Newsday reported.
The defense of Cruz’s place in the election is being argued by the New York Board of Elections, which put Cruz on the ballot, NBC added.
Cruz, a lawyer, was elected to be a senator from Texas in 2012, Newsday added.
How do these citizens have standing? Everything I have heard is that individual voters do not have standing to bring such a suit, but that another candidate might have standing.
If you are a citizen automatically at birth, then you are natural born. If you are also born in the US, then you are native born.
True, but the state issue is whether he can be on the state’s ballot. Any decision will be appealed to the federal court.

The issue is whether Ted Cruz is a natural born citizen, which different than citizen.
One is naturally a US citzen when there is no alternative.

If one could be something else because of place or parentage at birth, one cannot be a natural born citizen.
Not according to these buffoons. They string together a 19th century quote here and there and claim that the law is “clear”. It is, and those who say Cruz and Rubio are not NBCs are wrong. This is beyond absurd.
If you want Trump and not Cruz or Rubio, fine. Vote for Trump. Just take off the tin foil hats, please.
When the Constitution was written the child followed the Father not the mother.
Before marriage tradition became under liberal assault, the woman became as one with the man, and the man was the one.
Logic dictates the child follows the father just as the child inherits his name to carry on the family.
Cruz's father was either a Canadian citizen or was in the process of becoming one.
You have to go back and look at the meaning of the words at the time they were written, not the modern day "living" changes.
If you're an originalist, that is.

The ones who instituted this lawsuit have done this with no other intention than to distract the ignorant and hurt Cruz.
It was a deliberate act to stir up the ill-informed. Just one more sleazy Trump slur aimed at the media to carry and distract for a news cycle. The stumbling blindfolded are doing so.

I think this is the crux of the argument. What naturalization process did Cruz go through? None as far as I know, and yet he has American citizenship. Does that not indicate that he had it from birth?
That’s one opinion, which I think is how I personally think SCOTUS would rule, but who knows. Since there are constitutional experts on both sides, it clearly is not settled. That should be obvious, but I get attacked by both sides who claim their opinion is fact. Now what about this—it goes to SCOTUS and you have a 4/4 split on whether Cruz is eligible? What then?
Children born abroad must get a Consular Report of Birth Abroad (CRBA) which is sent to the State Department for approval.
They approve citizenship via statute, Cruz cannot be NBC if he became a citizen via statute.
Natural born requires nothing, you are NBC virtue of the soil and the parentS citizenship (blood).

Agree, by the same logic neither is Cruz.
Not that it really matters anymore, the constitution is only as good as what is convenient for today.
If this gets approved, then Obama should never have been president.
Maybe they can shop for a judge in Travis county. Austin has a kangaroo court system that targets Republican politicians and the grand juries of Democrats are willing to oblige.
