A New York judge will hear arguments on Tuesday in a lawsuit that challenges Republican Sen. Ted Cruzs ability to run for president given that he was born in Canada.
State Supreme Court Justice David Weinstein will hear the claim of two men who contend that Cruz is not a citizen of the U.S. and is therefore ineligible to run for president, NBC has reported. Cruz was born in Alberta, Canada.
Barry Korman and William Gallo will argue that despite Cruzs mother being an American, the senator is not a citizen because such status cannot be passed from parent to child, Newsday reported.
The defense of Cruzs place in the election is being argued by the New York Board of Elections, which put Cruz on the ballot, NBC added.
Cruz, a lawyer, was elected to be a senator from Texas in 2012, Newsday added.
Well now wait a minute naturalization is defined as the process of a non-citizen becoming a citizen. Those born on US soil are considered citizens because of the way laws are written. Those born outside US soil under the right conditions are citizens because of the way laws are written. All citizenship is defined by one law or another going back to the Constitution. The question is if Cruz was entitled to US citizenship at birth.

He has never released what the documentation is that states he is a US citizen. Somebody was saying yesterday that he must have had it to apply for his law license. That he hasn't released it is appalling.
Your original statement was convoluted. It didn’t look like that was what you were saying.
It is nonsense, but some of what you say is not quite right. Elections are the responsibility of the states, including determining the eligibility of candidates, including candidates for Federal Office. But, the first level of courts will determine the facts and apply the law. The courts, if they even take the case, will rule that on both the facts and the law, Cruz and Rubio are eligible. They will appear on the ballot. The games will likely end at this point, because the appellant courts will laugh and it will be over.
If you are born on American Soil by two American parents then you are considered ‘natural born citizen’ same as I am...both of my parents were born on American Soil, one Cook County, Ill. and the other one in Salt Lake County, Utah...and I was born in Provo, Utah County, Utah...I am a ‘natural born citizen’.....

The court are not interested in bothering with this, unless some lunatic court overturns the existing law. I don’t think that this will ever reach the Supreme Court.
Exactly. There is no doubt that I’m a NBC. No law makes me an NBC, I just am. You can’t be an US NBC if you hold dual citizenship, you can’t be an US NBC if born in a foreign country. You can’t be a US NBC if one of your parents isn’t a US citizen.

The 14th Amendment applied to African American Slaves. Native Americans weren’t citizens from the 14th Amendment.

Statute law can make one a legal citizen, but it can’t make one a Natural Born Citizen.
Yes, both Cruz and Rubio are Citizens of this country. That is not in dispute. The entire question at hand is, are they Natural Born, as understood and required by the Framers of our Constitution?
The answer is clearly No, as they aren’t ‘naturally’, by the very condition of their birth, of THIS country and no other.

Probably not. However, if it were hypothetically a servicewoman who gave birth to a child overseas whose father was a citizen of another nation, then perhaps yes (depending on your interpretation of NBC). This scenario is more analogous to Cruz’s particular situation.

There are no “high or low” standards for citizenship. Do you not know how to read the Constitution?
The is no lawful Constitutional definition of Natural Born Citizen. There are only Natural and Naturalized citizens. There is no third level.
This sticky NBC situation was unintentionally or maybe even intentionally, left undefined by the very Founders that put it in the Constitution.
I contend they put NBC in to cover their post Revolution world sometimes hard to define USA citizenship that could have been relatively easily infiltrated by British citizens at that time. The Founders and the new Americans knew exactly who was and who was not NBC. Once that generation was gone their knowing died with them as they chose to not define it as any special level of citizenship for future generations.
SCOTUS will avoid NBC like the plague, because it is a pure political question, not a legal or Constitutional one.
The only parties that can establish once and for all exactly what NBC is, is Congress. All they have to do is write an Amendment defining NBC.
