A New York judge will hear arguments on Tuesday in a lawsuit that challenges Republican Sen. Ted Cruz’s ability to run for president given that he was born in Canada.
State Supreme Court Justice David Weinstein will hear the claim of two men who contend that Cruz is not a citizen of the U.S. and is therefore ineligible to run for president, NBC has reported. Cruz was born in Alberta, Canada.
Barry Korman and William Gallo will argue that despite Cruz’s mother being an American, the senator is not a citizen because such status cannot be passed from parent to child, Newsday reported.
The defense of Cruz’s place in the election is being argued by the New York Board of Elections, which put Cruz on the ballot, NBC added.
Cruz, a lawyer, was elected to be a senator from Texas in 2012, Newsday added.
“If you are a citizen automatically at birth, then you are natural born.”
Not necessarily so.
If an American citizen is born outside the territorial jurisdiction of the United States, he/she has at least two countries that can lay claim to their allegiance.
The question in such a circumstance of birth is, which country is he/she rightfully born to? The claim on their allegiance can be strongly argued both ways.
In Ted’s case, it’s even further complicated by the fact that his father was a citizen of yet a third country.
If a child is born in a country, to two citizen parents of that country, there is no doubt as to their citizenship, as they can NATURALLY be a citizen of NO other country, thus the term, ‘Natural Born Citizen’.
If the nationality of Cruz is in doubt, then wth is Obama?
But with Cruz there’s no question. It’s all admitted. With Arthur he’s officially born in the USA
No, the US Constitution determines that, not some judge. And BTW, where was this judge in 2008 when Obama was running?
That’s the problem, we don’t know, we have a Hawaii b.c. and a Kenyan b.c. and he has everything locked up...
We should have demanded then that he prove is a Natural Born Citizen and we didn’t...
How did these guys get ‘Standing’?
Every court previously has denied ‘standing’ to every person who has tried to get 0bama’s Constitutional eligibility confirmed. They said only Romney (or previously, McCain)could have ‘standing’, and of course neither one of them wanted to do that.

Mitch McConnell would not allow the senate to take up the issue like they did for McCain. Keep in mind that Cruz called McConnell a liar. Also, McCain despises Cruz as well and has called him a wacko.
That leaves it up to the people. If Cruz won the nomination and presidency, would the senate refuse to recognize him?

Local Attorney Suing To Challenge ‘Natural Born Citizen’ Status Of Ted Cruz

Philadelphia (CBS) – Norristown Attorney David Farrell has filed a lawsuit challenging Texas Senator Ted Cruz’s status as a ‘natural born citizen,’ and his eligibility to run for President.
Speaking with Rick Grimaldi on 1210 WPHT’s Rich Zeoli Show, Farrell explained his goal is to clear up the issue, not to advocate for an opponent of Cruz.
“It wasn’t out of any political motive whatsoever. To be perfectly frank, I’m tired of hearing about it. I’m tired of it being an uncertainty in American politics. It’s a shadow around the entire electoral process. It has to be resolved at some point.”
He claimed the matter should be determined now, before the nominating process is finished.
“I am a Republican, so I think that’s an element of standing. I can be directly effected by this. I think any Republican should have an interest in making certain that their vote counts. Let’s say I decide to vote for Ted Cruz. Well, if I have this cloud of uncertainty hanging over his candidacy, how can I be sure that my vote is going to count.”
Farrell said the lawsuit against Cruz is the best way to put this issue to bed forever.
“This is the purest case to flesh out, once and for all, what does ‘natural born citizen’ mean.”

Uh, doesn’t that depend on the laws of the two countries?
Cruz was born in Canada in 1970, Canada did away with their dual citizenship in 1977....

The question is not if Cruz is a citizen. To the best of my knowledge, Cruz is now a USA citizen.
But since a USA citizen is not necessarily a natural born USA citizen, the real question is whether or not Cruz is a natural born USA citizen.
From the US Constitution:
Provided that no Amendment which may be made prior to the Year One thousand eight hundred and eight shall in any Manner affect the first and fourth Clauses in the Ninth Section of the first Article; and that no State, without its Consent, shall be deprived of its equal Suffrage in the Senate."
The above excerpt demonstrates that there is no limitation whatever to the content of amendments to the Constitution, with the exceptions above, one of which has expired.
The Fourteenth Amendment derives its authority from the explicit authority granted to Congress and the States to amend the Constitution. No other authority was required.
Interestingly, the method of amending the Constitution excludes explicitly the authority to cause any state to have a different number of Senators than any other state. By implication, changing such suffrage would apparently require writing and ratifying a new constitution and somehow disposing of the existing one.
Sure-— my point exactly. But it was pursued....as now.
