Lawsuit Over Eminent Domain Could Snarl Bush Library Plans (Flashback 2006)

The school favored to host the George W. Bush Presidential Library, Dallas's Southern Methodist University, may encounter a snag next week in the form of a lawsuit alleging that the school has improperly seized local homes in order to secure land for the proposed library site.
Amid increasing outrage among Republicans over the use of eminent domain and other coercive measures to obtain private property for public projects, a case in Dallas County's 134th Civil District Court, which is set to begin on Tuesday, will determine whether the university violated its legal obligations to local homeowners in an effort to secure the land currently occupied by the University Gardens condominium complex, a potential library site.
"They're taking my home," said Gary Vodicka, one of the litigants and a University Gardens owner and resident, yesterday.

Laws can't overrule a court decision like an amendment does. Actually, they can. Laws have been used to overrule court decisions many times. Laws can't be used to change the Constitution - that requires a constitutional amendment.

The Supreme Court decision stands as law in the Keno case, sadly. I don't like it but the Keno decision was not in play for the Trump case.
I am OK with people attacking Trump on eminent domain. But it seems those doing the attacking are hypocrites.

It wasn’t just a city thing and was quasi-city at that.
Bush was managing general partner and the face of the franchise and was lobbying for a new stadium.
In April 1991: The Rangers shepherd through the Texas legislature a bill that creates the Arlington Sports Facilities Development Authority (ASFDA), a quasi-governmental entity that is given the power of eminent domain. Shortly after the bill is signed by new governor Ann Richards, 13 acres of private property are seized for the Rangers’ new ballpark, later prompting two lawsuits.

James Madison, who wrote the Fifth Amendment to the United States Constitution, had a more moderate view,
and struck a compromise that sought to at least protect property rights somewhat by explicitly mandating compensation and using the term "public use" rather than "public purpose," "public interest", or "public benefit".[5]
The Fifth Amendment imposes limitations on the exercise of eminent domain:the taking must be for public use
and just compensation must be paid.

The Kelo case said that the Constitution did not prevent a state or city from using eminent domain the way that New London did. It did not say that Congress or states could not pass a law against such a use or that such a law would be unconstitutional.

It is just an assumption that Kelo would override such laws. If not the case that is a great thing to be able to short circuit that decision.

If the property was abandoned or the owner isnât paying property tax that is one case. Why should there ever be tax on your homestead? You can never own anything, you can only rent from the government, they just don't call it rent, they call it property taxes.
