The Kelo case said that the Constitution did not prevent a state or city from using eminent domain the way that New London did. It did not say that Congress or states could not pass a law against such a use or that such a law would be unconstitutional.

It is just an assumption that Kelo would override such laws. If not the case that is a great thing to be able to short circuit that decision.
