Ted Cruz's fmr. professor says Cruz is a hypocrite on the Constitution VIDEO

Thursday following FBN's broadcast of the Republican presidential debate, Harvard constitutional law professor Laurence Tribe attacked Sen. Ted Cruz (R-TX) 97%, one of the participants in last night debate, for his stated on reasoning for his eligibility to run for president of the United States.

According to Tribe, Cruz applies a double standard to his interpretation of the Constitution, to which he deemed Cruz to be a "constitutional opportunist" and a "hypocrite."

"I've done a lot of historical research on it, and so have a lot of other people, and the best evidence seems to be that what they meant in 1788 was something more than just citizen from birth," he said. "They actually meant a citizen whose birth was sort of natural, not in a biological sense but in the sense of connection to the land. The idea was, that it was something that Congress couldn't change, unlike the naturalization process, which Congress has monkeyed around with all the time. I mean, for example, in 1934, the first time it said, you can be a citizen who doesn't need to get naturalized as long as your mom was an American citizen. And that's ultimately the basis on which Cruz has to rely.

The funny thing is, that the kind of guy Cruz is, he's always been this way. When he was my student he was this way. He's always said the Constitution always means the same thing that it meant when it was adopted. That's why he made this funny joke to Trump, you know, saying, the Constitution didn't change since last September. Well, he thinks it didn't change since 1788 when it comes to gays and, you know, women and other things. But when it comes to his own ambition, he's suddenly becomes what he accuses me of being, and it's a pretty true accusation, a judicial activist. That's not the guy he is normally."

"He's being a constitutional opportunist, a hypocrite," Tribe continued. "It's sad, because he makes light of it, but it is a genuine open question, and there's no way of getting around it. Like if he's the nominee, it won the be hard to imagine some secretary of state somewhere simply refusing to put him on the ballot on the ground that that secretary of state is also an originalist and thinks, if you weren't born on the land of the United States, then you just can't run. At that point, somebody would have to sue them, whether it's Ted Cruz himself as the nominee, if that's what we've got, or the Republican National Committee. There's no way to avoid an issue like that going to the Supreme Court. And the irony is, the liberals on the court, assuming they all voted according to principle, as opposed to politics. It isn't always that way, the liberals on the court, the activists would go with Cruz, and the originalists if they were true to their position like Scalia, would vote against him."

This has now become a war to the death.

Democrats don't fight fair, including Trump.

Casus Bellei!

We have rough edges here, from where the Court went at questions like this from different angles.

The USSC is NOT nonpolitical any more if it ever was (there is an adage that the court follows the election returns, which in the present case is Obama).

Methinks the proverbial stars are saying Cruz, you are under a shadow in your presidential campaign. Be a senator. God needs you in the Senate.

Trump is kind of Machiavellian as well. BUT — he is proposing a kind of situational Magna Carta in the sense of a deal with America. We need to take this seriously, I urge. The parameters of what would make America great could hem him in, in a constructive way. Negotiators don’t need to be super brilliant here. They just need to keep their eyes on the ball.

Trump changed his mind about PP, once he found out about the selling of baby parts.

Like it or not, legal abortion is the law of the land, as is Eminent Domain.

You don't like Trump...I get that, but if he isn't the next president this country is done for.I'm certain that you disagree with me about that, but I'm correct.

Rant and rave away...I shan't reply to your misguided and incorrect positions. And yes, I am smarter than you are and a CONSERVATIVE !

Meow spit. The result looks like a pile of cat hair more than it looks like conservatives, when we get to the end.

But anyhow yes, America has painted itself into these legal conundrums. If Trump gets it put onto his Make America Great agenda that something should be done here... I think Trump would do it. Trump comes at this as businessman and facilitator, yes that means somewhat amoral, but we can make hay while this sun shines anyhow. Amoral is easier to deal with than immoral.

So did Kelly Ayotte. The other way. She went from strongly anti PP to hiding under her desk regarding PP. This is going to be a long, long battle. Congress & the pop culture is rotten to the core.

For this I’d want to know how we heard about the lies too. Just wanting to be utterly right about it. URL to a good source would be ideal.

This is not taking Cruz “down.” This is going to be a big fat GOAD to get him to concentrate on Senate work. This is where the grace of God is going to be for him. It’s going to matter with Trump as president.

And I am SO damned weary of replying to mental midgets and the uneducated here ( not YOU, you know who I mean ), that I could scream!

I would rather take the opinion of his other professor, Robert George, his thesis advisor at Princeton and acknowledged Natural Law expert.

Frankly, I'm SO not tech savvy, that I am the wrong person to ask for such things as a URL; though I know what that means...just NOT how to get it.

There are articles ( many ) about what I posted on this site. Does that help any ?

The only point is that there is doubt, and Hillary will use it.

Not nearly as often as she will run ads showing a copy of the check Donald Trump stroked to her election campaign. And in the end, Cruz will be vindicated, while Trump will be known as a Clinton donor, primarily because he is.

Finally someone gets it. In the end, it doesn't MATTER whether or not Cruz has legal standing to run. He's a conservative and WE have to play by different rules -- we all know that. The media and the legal system is so heavily stacked with leftists, they would do all they could to use this against Cruz, right or wrong. No, it's not fair, but it will continue and we all know it.

When Cruz denounced his Canadian citizenship and was asked if he was eligible to run and he assured everyone he was, it made me very uneasy. All i kept thinking about was the scenario that is now unfolding. With 50 states in the mix, all it would take is one dem SOS to create an insurmountable problem for his candidacy. And so, here we are.

Back then, i dismissed it because, well... he's the Constitutional expert, not me, and i kept telling myself that he must know something that I don't since I've never studied this birther thing closely. But i never figured out just how he was going to handle the dem lawyers that i figured would come out of the woodwork if he did well in the race.

Y'all say what you want, but I don't know who's more arrogant and narcissistic, Trump or Cruz. What was Cruz's plan? To just ignore the democrats? He had to know they would raise all kinds of birther problems for him later!

If he doesn't pull some surefire proof of eligibility out of his pocket, and SOON, then someone please tell me why I shouldn't think he's the most selfish republican politician on the planet. Part of me is mad at Trump for pushing this, but dang it, he has a point. If Trump doesn't talk about it now, the dems WILL but they'll wait until after Cruz won the nomination.

I hate politicians.

Any devil problem has a God answer.

The playing fields are all our individual hearts. We can tilt them one way, or the other. On level field, God wins hands down. But God is a “Choose righteousness” God. He wants love of Him (or hate, the alternative) to be voluntary.

Let’s get our own faith ducks in a row then we can stare down the devils that propel folks like Ayotte, grin at them, and say YEE HAW you are doomed... and it will be so. Because we will carry the power of God that casts Satan out.

I am SO looking forward to seeing such a battle GO DOWN... against Satan. What a deserving loser. With the side effect of won souls, but by all means won by God not by Baptists or Catholics or what name you other name beneath the name of Jesus.

YEE HAW let’s put our faith where our mouth is. YEE HAW.

Someone can. I’m not as savvy on such sources as others might be.

Anyone who wants to do it on Donald can do so too... but again we need to evaluate such data against who the person is claiming to BE. A negotiator who has been all over the map is not necessarily bad. A negotiator who has not honored what he has negotiated (barring force majeure) is a different matter.

True and by now, the means does indeed justify the result. This nation is barely hanging onto the edge of the precipice by the tips of her fingernails.

Trump is the ONLY one who can begin to pull her back; if it isn't too late by then....which it might be!

Well, I think Trump has abused his claimed role less badly than Cruz, his. Being a stellar conservative has a cost that a more ambiguous figure does not have.

But even if WE forgive, Democrats won’t. Trump keeps them off balance which is good. We need that.

Again, he never naturalized. He has always conducted himself as if he is a natural born citizen. If you find evidence, please post it.

Good luck with that. Proof is in very short supply with these Trumpbots - many of them fairly new to FreeRepublic, or Conservatism for that matter.

I look in terms of what opens the road for favorable divine action, if the prayer support is there (and as I pointed out to Nathan Bedford, Obama is a pretty good prayer generator — like he is a good gun salesman).

Trump could serve here. He is open in all the right areas for this. He said let’s make a deal. Politicians that we DO trust should be stepping up to him for that, with agendas as godly as they can get them to be. Even if Cruz bows out, then he could also serve as deal gelling person to Trump. Which would be another “Just threw me in the briar patch!” move for Cruz.
