Former House Majority Leader Tom DeLay told Newsmax TV on Wednesday that Ted Cruz might ultimately "end up in the courts" on the question of his citizenship and how it might affect his presidential campaign. "I've had this problem ever since Cruz announced," DeLay, the five-term Texas Republican who served from 2003 to 2005, told "The Steve Malzberg Show" in an interview.
"There is a difference between the definition of natural born and naturalization â and it has not been settled by any branch of government. "Cruz needs to address this in some way because it is a cloud right now in Iowa," DeLay said. [...]
DeLay, however, told Malzberg that the "most expedient" way for Cruz to settle any questions is to work through the courts. "You can't do anything through Congress," he said. "Congress isn't going to pass any bill to protect him â and I'm sure [President Barack] Obama wouldnât sign anything. "He's going to the courts if he's the nominee. The Democrats will use every avenue available to them.
"They sued me over a valid issue," DeLay said, referring to a 2006 lawsuit brought by Democrats after he dropped his re-election bid. "They'll sue him. "He'll end up in the courts one way or another."

The fiction propagated about Barky was that he was born on US soil. Cruz was born in Canuckistan without a doubt and proudly maintained his hockey loving Canadian citizenship until late last week.
‘Cruz needs to signal that he will approach the Supreme Court, once seated as POTUS, to provide clarity once and for all as to the term “natural born citizen” whether it works for him or not.
Cruz needs to continue his campaign “in good faith” that he would be found a “natural born citizen” based upon Obama successfully executing that office for two terms
Cruz needs to deflect detailed investigation as to his eligibility at this time as he cannot reasonably expend the time in court while on the campaign trail’
The point that keeps getting missed is that what would satisfy us will not satisfy the Dems. Some conservatives seem to be having a hard time grasping that if Cruz is the nominee, the Dems will litigate this issue to hell and back. The MSN will enable them. The political firestorm will be practically unprecedented.
I agree. It was not a ridiculous notion. There was a very straightforward goal, easily achieved. But people today are trying to twist a simple thing into a profound legal and constitutional puzzle. That’s what I was objecting to. Ted Cruz’s mother was born in Delaware. Ted was an American from birth, with dual nationality in Canada because his dad was working there at the time. Ted qualifies.

Exactly. If you are naturalized there is paperwork making you a citizen. if Cruz is a citizen because he was born to an American Citizen then he is not Naturalized.
No. He was made a citizen solely by virtue of the generous provisions of the 1952 Immigration and Naturalization Act, not by nature.

That simply cannot be right. They don’t know who the presidential nominee will even be for either party. Probably Hillary for the dems, but who knows. And there’s no idea with the republicans, although Trump is in the lead.

And even then, a convention does have final say. They ‘can’ change things.
Does that then mean Viet Nam born children of an American soldier “citizen parent” who had “resided in the United States for at least 10 years, including five after the age of 14” are eligible? ...or also soldiers in Iraq, Germany, Turkey, etc. etc.? This could lead to a fascinating cast of future presidents. I guess allegiance could not be an issue then(?).
