‘Cruz needs to signal that he will approach the Supreme Court, once seated as POTUS, to provide clarity once and for all as to the term “natural born citizen” whether it works for him or not.

Cruz needs to continue his campaign “in good faith” that he would be found a “natural born citizen” based upon Obama successfully executing that office for two terms

Cruz needs to deflect detailed investigation as to his eligibility at this time as he cannot reasonably expend the time in court while on the campaign trail’

The point that keeps getting missed is that what would satisfy us will not satisfy the Dems. Some conservatives seem to be having a hard time grasping that if Cruz is the nominee, the Dems will litigate this issue to hell and back. The MSN will enable them. The political firestorm will be practically unprecedented.

100% agree. We conservative birthers have been castigated on this forum for staying true to Constitutional originalism. My response to ad hominems is that the conservatives who have to resort to ridicule at this stage of the game against fellow conservatives, will be absolutely blitzkrieged by liberals in due course. It's a sign they are ill-prepared and will not win.

That's why Cruz must indicate he is running a campaign "in good faith" that just as Obama was vetted, he too would be vetted, and found eligible. But also, he must signal to conservatives that he would approach the SCOTUS once seated as POTUS for clarity on the matter once and for all. That buys him enough time with the conservatives to become the nominee; one hurdle satisfied. It also deflects the spotlight to Obama -- "if he's in, I'm in" -- which will deflate some of their sails in order to avoid the "fruit of a poisoned tree" doctrine undoing Obama's work. They can't enjoy "stare decisis" with Obama while attacking Cruz on the same grounds. And finally, SCOTUS can safely duck the issue until the election is over and the POTUS is seated as SCOTUS's purpose is legitimately not to provide consultation in future events (as John Jay specifically told Washington with regard to foreign treaties, if I recall correctly) but to litigate after the fact.

It's a three pronged offense. And I don't see Cruz getting the nod any other way but to employ it.
