Judge Nap: Cruz's American Citizenship Is Settled and Established

Donald Trump continues to raise the issue of Sen.Ted Cruz's (R-Texas) American citizenship.

In a Fox News Sunday interview (below), Trump argued that the Canadian-born senator must "get this problem solved" before potentially running against a Democrat in the fall and facing a lawsuit.

"Does 'natural-born' mean born to the land, meaning born on the land? In that case, he's not. But nobody knows what it means because it hasn't been adjudicated and it hasn't gone to the Supreme Court," said Trump.

On America's Newsroom this morning, Fox News senior judicial analyst Judge Andrew Napolitano said that Cruz's American citizenship is "well-settled and established" under a law that goes back 100 years.

Napolitano said Cruz's citizenship cannot be questioned, since his mother was an American citizen when he was born.

"A human being born in another country with at least one parent who is an American citizen, who lived in the United States for at least one year during the parent's life before the birth, is an American citizen. That is exactly Ted Cruz's situation. ... [He] is a natural-born American citizen," Napolitano explained.

He agreed with Martha MacCallum that the reason for bringing this up is "political," not legal, since many voters may not know the law.

Napolitano said Cruz could benefit from getting this cleared up now, rather than later. But he noted that Trump is correct that the Supreme Court has never reviewed the law "because the issue has never come up."

I assume you have heard of Charles Gordon. Surely. General Counsel for INS. Wrote a well respected treatise on Immigration

Look up his law review article on the subject in 1968.

The question is not whether Ted Cruz is an American citizen.

The question is whether he meets the qualifications for natural born citizen in the Constitution for the office of President, as Cruz was born with dual nationality in a foreign country.

The Judge never misses an opportunity to muddy the waters.

As far as I know no one is questioning whether or not Cruz is a citizen. He is without doubt!

Whether or not he is a “natural Born” citizen is an ENTIRELY different question!

That’s right and Queen Noor of Jordon who never formally renounced her American Citizenship conferred NBC upon her princelings who once they fulfill their residency requirements can run for President and become the first Arab Princes to become US President because their mother conferred NBC upon them! Aint it wonderful!

Just so I understand this: If osama bin laden’s wife was a naturalized citizen and delivered and raised a kid in Pakistan, that kid would be eligible to be POTUS at 35? Am I understanding this correctly?

Until the courts agree to review, it’s settled to the extent that the law stands. The courts will never touch this with a 10 foot pole. They don’t care about this issue, don’t think that it’s a valid question, and are never going to get in the middle of this. Meanwhile, let the babble continue.

Speaking of residency requirements - there was an issue with Herbert Hoover but no one ever challenged it. Dems of yore must not have been like the ones today.

I don’t know if that one has been rectified either.

I didn’t know about it until I read the Charles Gordon law review article that talked about it.

Napolitano is never correct about anything. But contrary to the good judge’s assertion, the issue is not “settled”. Blatant lie by the judge.


Even Tribe says the issue is not “Settled”..Judge Nap is as disingenuous as Cruz.

Levin is a fraud, but as for who to believe, probably whoever has the best evidence! Appeals to authority are a logical fallacy.

Speaking as one of the many Cruz Trump supporters, my opinion of Trump has taken a huge hit over this.

Not to mention how he lied and said he was just asked a question..... well he is still bringing it up

and so laughable to see so many running with the talking points that Trump is only trying to help Cruz

The judge Napolitano and Levin need to be schooled by Trump.
