The media are focused on the “Bundy Militia” angle to the standoff in Burns Oregon, where Aamon Bundy and brothers have taken over a Malheur Wildlife Refuge Headquarters to draw attention to the plight of the Hammond family (Full Complex Back Story Here).
However, a little research (HatTip NeverTooLate) into the original legal battle reveals a rather startling update.
The initial, and regarded by many as overreaching, federal prosecution resulted in a federal court judge Michael Hogan assigning a 3-month sentence and 1-year sentence for Dwight Lincoln Hammond Jr (73) and his son, Steven Dwight Hammond (46) respectively.
Even federal Judge Hogan stated the prosecution under “terrorism statutes” itself was an overreach and he refused to assign ridiculously high sentences for behavior that almost every rancher has conducted for generations.
Those sentences were fulfilled by the father an son duo in 2013 with Steven Hammond exiting prison in January 2014.  However, it was a decision by a U.S District Attorney named Amanda Marshall which called for an appeal to the sentencing:
"Amanda Marshall: Former U.S. Attorney for Oregon. Marshall recommended that the federal government challenge the Hammonds; original prison sentences. By law, the convictions come with mandatory five-year sentences, but U.S. District Judge Michael Hogan in 2012 balked at the punishment and instead sentenced Dwight Hammond to three months and Steven Hammond to one year.
Marshall called Hogan's punishments "unlawful." The solicitor general authorized a rare appeal of an Oregon judge's order. The appeals court sided with the prosecution, and the Hammonds returned to federal court last year to face a second sentencing. At that hearing, U.S. Chief District Judge Ann Aiken ordered the pair to finish

I've read the same claims, but also read that burning was banned that day because BLM had fire fighters in the area who could have easily gotten caught up in an out of control backfire.
Selective facts don't tell a complete story. Again, best to hear all sides. In our system. that's what jurys are for.
And we’re just talking about land grabs. There are also the political persecutions by the IRS. Thousands of FFL holders driven out of the gun business, many through criminal prosecutions for clerical errors, by the ATF. And now we’re seeing the DoJ go after churches and businesses for their religious beliefs. Where do you even start on EPA abusiveness?

I haven't read the statute nor heard the evidence against them, so I can't say.
It sounds like a stretch to me but again, I'm much more likely to blame our representatives for writing a stupid law than criticize a prosecutor or court for following and upholding that law.
Hogan retired the day he handed down his decision. I read that there was cake in the courtroom.Right out of John Grisham.

The back fire saved the Hammond house AND WINTER FEED. Now, WHY would the BLM not want to help save the Hammond’s home and winter feed, such that the BLM would have come and helped the Hammonds, being the ‘righteous’ ‘public servants’ that they had demonstrated themselves to be toward the Hammonds? /snark.
OTOH, wouldn’t it have been a great boon to make sure the Hammond property was just a ranch too far...

I can't think of any reason, but they may have had a greater interest in protecting the lives of the firefighters they had sent into the area.

Again, best to hear all sides. In our system. that's what jurys are for.The problem is the jury in this case was barred from hearing many facts by the presiding judge.
Based on some of the reports I've seen, they weren't even informed of the exact charge against the defendants. That doesn't sound like the way the "system" is supposed to work.
How terribly noble. Is jury nullification anarchy? Because we are dealing with an unjust application of the law here.

One of my brothers was building a barn and saw some hikers walking near his property and went over to say hello. It turns out they were Tree Huggers and they told him they had seen a Spotted Owl and were going to report it and he had better not clear out any more trees for his out buildings until he was notified that it was okay to do so.
To make a long story short, he got his shotgun and found the Spotted Owl. The people came back the next day and he told them they needed to stay off his property. They became very frustrated that they couldn’t find the Spotted Owl. After that, nothing ever came of it.
