A Philippine court on Tuesday convicted a U.S. Marine of killing a Filipino last year after he discovered she was a transgender woman in a hotel in the Philippines while he was on a break after participating in joint military exercises in the country.
Lance Cpl. Joseph Scott Pemberton was convicted of homicide by first strangling Jennifer Laude and then dunking her head into a toilet bowl in the hotel they had checked into after meeting in a disco bar in Olongapo city, northwest of Manila. He was sentenced to 6-12 years in jail, with time already spent in detention credited, said court clerk Gerry Gruspe.

Tricking someone into thinking your are female when you are male ought to be a crime of sexual assault, especially when it goes far enough to get the person into a hotel room.

The Philippines has a crime of passion law, like most Latin countries. The legal system is derived from the Spanish colonial one, and was not switched out by the US.
Extreme emotion is an extenuating circumstance.
It is sexual assault, in my opinion, in that the guy did not give consent to a man or a man pretending to be a woman, or a “woman” with a penis. It should be criminal sexual assault by the trickster. That does not excuse murder, but neither does it make the dude entirely innocent. He was in the process of committing sexual assault.

I was in the Marine Corps as well and was accosted by prostitutes whenever I left the base. But I never partook. The whole scene just seems kind of skanky to me.

It’s not rape by fraud, since he got fellated as he wished. He consented to perverse sexual contact, which was perverse whether the fellator was male or female.
There is no excuse for the murder unless the man was trying to force himself on him. Even if not, to present yourself as a woman (when a man) to a man, with the intent of having sex, should be considered sexual assault. Even if all it is is kissing, it is not with consent because of the deception.
He was not doing what he was paid to do if he was presenting himself as a woman. It was deception. Clearly the marine would not have participated if he knew the prostitute was a man. That should be considered sexual assault. It was not consensual. The marine did not consent to having sex with a man or even a transgender nutcase. He was tricked into it.

Saying he got what he deserved is like saying a woman got what she deserved if she is raped when she is dressed immodestly. You may disagree with the behavior and/or see it as unwise. That does not mean the person deserves to be violated in any way against their will.
It IS rape by fraud because the performer was male, in which case he would never have consented if he’d known.
