The far-right wing in both America and Europe have seized on the Paris terror attacks as an excuse to turn away the thousands of desperate refugees who are fleeing the terror and violence of ISIS. Thirteen American governors (all Republican) have announced they will refuse to accept Syrian refugees in their states, demonstrating a remarkable ignorance of Constitutional law. As ThinkProgress noted, "the Supreme Court explained in Hines v. Davidowitz, "the supremacy of the national power in the general field of foreign affairs, including power over immigration, naturalization and deportation, is made clear by the Constitution." States do not get to overrule the federal government on matters such as this one."
Those declarations by GOP governors are riding the wave of Islamophobia coursing through the right-wing. Jeb Bush and Ted Cruz both proposed profiling refugees by religion and "only accepting Christians," because despite the fact that Christian terrorist attacks take place in our country on a regular basis, Cruz thinks "there is no meaningful risk of Christians committing acts of terror." Trump said that he would "strongly consider" shutting down mosques in America, completely contradicting his widely professed devotion for "religious freedom." Mike Huckabee called for the new Speaker of the House, Paul Ryan, to halt the "importation" of refugees or resign.
President Obama ripped these xenophobic bigots in his Monday press conference, chastising them for abandoning American values and buying into their own fearmongering:
"When I hear folks say that, well, maybe we should just admit the Christians, but not the Muslims, when I hear political leaders suggesting that there would be a religious test for which person whoâs fleeing from a war-torn country is admitted, when some of those folks themselves come from families who benefited from protection when they were fleeing political persecution, thatâs shameful. Thatâs not American. Thatâs not who we are. we donât have religious tests to our compassion."
He is absolutely right. While there are certainly dangers we need to address, this kind of reaction from the right-wing is exactly what ISIS wanted. By reacting with fear and discrimination, we marginalize more Muslims and push them into the arms of extremists. The passport that indicated one of the attackers was a Syrian refugee is likely fake, and an obvious plant to inflame fear of refugees. These people are desperately fleeing their homes because the murderous horrors of the Paris attacks are a daily occurrence in ISIS territory â a mass grave of eighty murdered women was recently discovered in Iraq's Sinjar province by liberating Kurdish peshmerga units. It is our moral obligation to accept and protect the incoming refugees in the face of unthinkable violence.

The Mayors of sanctuary cities of demonstrate the same remarkable ignorance of Constitutional law.
I wonder, do any state constitutions have such language as “clear and present danger” in them?

If that’s the case then the governor’s can then accept them, put the refugee’s back on a bus and then send the bus to Washington D.C.
There are lots of empty government buildings there, and elsewhere, so Washington D.C. can deal with them there.

Obama has made a mockery of the law and the Constitution.
I was just reading an article in the 60th anniversary edition of National Review. It was about the rule of law and how the Magna Charta was the beginning of it in England and all the countries which now base their laws on English Common Law.
It explained how revolutionary it really was and how our Constitution contains many things which originated with the Magna Charta.
Obama and to some extent, Clinton before him have simply made their own laws through executive orders which were not intended to be a non legislative implementation of whatever they wanted.
Of course the Courts have been doing the same thing since at least the Warren Court.
Being worried about ISIS being embedded within the ‘Syrian refugees’ coming to America is “far-right wing”.. I don’t know whether to laugh or spit.

The right of self-preservation is the first part of the laws of nature.
The Constitution, rightly understood, does not in any sense attempt to overrule the laws of nature.
And in this case, the Constitution absolutely requires the general government, the national government, to protect the States from invasion.
If the general government will not uphold their end of the bargain, then it is absolutely incumbent upon the States to take up that existential obligation once again.

We are in uncharted territory here. Where does one find constitutional authority to the resist the unconstitutional actions of a man who governs by the pen and the phone.
Bottom line, he called the play of lawlessness and that is where we are going.
So, the Supreme Court has made their ruling.
Let them enforce it.

The Obama administration has told states to disregard Federal law on deporting illegals.
By not only failing to enforce the entire law but forbidding its enforcement they have voided the entire law.
The Obama administration rules by fiat with no respect for the Constitutional process, culture and systems that created the law.
Therefore there is no law to obey because Obama has destroyed the law. Any order coming from the Obama administration is meaningless.
Its OK to flaunt federal law regarding “sanctuary cities” though.
Do hope the agencies, most of which seem to be church related, have really big, really long term, sanctuary facilities.
So if a young, strong Muslim knocks on my door and asks to come in, I should just say yes? Am I Islamophobic if I don’t want to put my family at risk for a stranger?
I’ll tell you what, the scariest thing to me on tv or in movies is when they let the stranger in. Once that door shuts there’s no help, no stopping that stranger from whatever they want to do. It’s terrifying especially when it didn’t have to end that way.
We don’t have to take strangers in and expose our families to danger to prove we’re good-hearted people. Protecting our families comes first.
