The far-right wing in both America and Europe have seized on the Paris terror attacks as an excuse to turn away the thousands of desperate refugees who are fleeing the terror and violence of ISIS. Thirteen American governors (all Republican) have announced they will refuse to accept Syrian refugees in their states, demonstrating a remarkable ignorance of Constitutional law. As ThinkProgress noted, "the Supreme Court explained in Hines v. Davidowitz, "the supremacy of the national power in the general field of foreign affairs, including power over immigration, naturalization and deportation, is made clear by the Constitution." States do not get to overrule the federal government on matters such as this one."
Those declarations by GOP governors are riding the wave of Islamophobia coursing through the right-wing. Jeb Bush and Ted Cruz both proposed profiling refugees by religion and "only accepting Christians," because despite the fact that Christian terrorist attacks take place in our country on a regular basis, Cruz thinks "there is no meaningful risk of Christians committing acts of terror." Trump said that he would "strongly consider" shutting down mosques in America, completely contradicting his widely professed devotion for "religious freedom." Mike Huckabee called for the new Speaker of the House, Paul Ryan, to halt the "importation" of refugees or resign.
President Obama ripped these xenophobic bigots in his Monday press conference, chastising them for abandoning American values and buying into their own fearmongering:
"When I hear folks say that, well, maybe we should just admit the Christians, but not the Muslims, when I hear political leaders suggesting that there would be a religious test for which person whoâs fleeing from a war-torn country is admitted, when some of those folks themselves come from families who benefited from protection when they were fleeing political persecution, thatâs shameful. Thatâs not American. Thatâs not who we are. we donât have religious tests to our compassion."
He is absolutely right. While there are certainly dangers we need to address, this kind of reaction from the right-wing is exactly what ISIS wanted. By reacting with fear and discrimination, we marginalize more Muslims and push them into the arms of extremists. The passport that indicated one of the attackers was a Syrian refugee is likely fake, and an obvious plant to inflame fear of refugees. These people are desperately fleeing their homes because the murderous horrors of the Paris attacks are a daily occurrence in ISIS territory â a mass grave of eighty murdered women was recently discovered in Iraq's Sinjar province by liberating Kurdish peshmerga units. It is our moral obligation to accept and protect the incoming refugees in the face of unthinkable violence.
Oh yeah, Obama told us 22 times he did not have authority to let illegals in.
The Constitution is not a suicide pact.
Ok, now you did it. You just made the liberals heads explode.
Obama will not be mocked!!
Another ratchet click towards the inevitable civil war.
They need to sit down with Black’s Legal Dictionary and read it and the Constitution.
We probably have about two months before utter chaos ... unless Trump calms the masses
HE'S the man right now and if he takes contril before the election, we will be witness to the most amazing historical event !
There is a Constitutional guarantee to the States to protect them from Invasion.
The Trojan Horse Syrian terrorists represent an invasion of a proven hostile enemy.
Therefore, the States not only have a right, but an obligation to their Citizens to protect them when the Federal Government fails to do so.
Sorry Colon. This is Barry’s “fundamentally transformed” lawless America now. Nothing is “illegal”. Not even alien invaders. Get a life boy.
The governors have the power under the federal and state Constitutions to defend their states.
If Obama tries to militarily force these unvetted ‘refugees’ on actively resisting states the Dems would be crucified in the 2016 elections.
The comments over there are the usual claptrap.
Those people emote rather than think.
By reacting with fear and discrimination, we push “moderate” Muslims into the arms of maniacs who chop off heads and burn Christians alive.
Otherwise, they would be the religion of peace...
bttt
The Tenth Amendment, which makes explicit the idea that the federal government is limited to only the powers granted in the Constitution, has been declared to be a truism by the Supreme Court
All we need is some governors with some balls to activate their National Guard or State Police to keep these invaders out of their States.
“the supremacy of the national power in the general field of foreign affairs, including power over immigration, naturalization and deportation, is made clear by the Constitution.”
These aren’t immigrants. They’re refugees or migrants.
Even if Zero used his magic pen and made them immigrants, the “national power” has demonstrated its supreme fecklessness in this area for thirty years.
If our DC Lords want them, they can house them in Washington DC and the Virginia suburbs.
Shut it down!
Welcome to the Rule Of Mob.
Please go f —k yourselves! It would appear that the law is only good when you socialist like it to be enforced!!
“power over immigration, naturalization and deportation”
States and our citizens cannot assume that these ‘Syrians’ intend to immigrate, naturalize or otherwise assimilate here.
Insofar as German NAZIs or subjects of the Empire of Japan came to the US to undermine and commit to spying on and attacking it, so, too, do these ‘Syrians’ need to prove that they are not part of ISIS. It is precisely because of the precedents set in France that we can presume there are those among them who have evil intent against the US, much as those German NAZIs and a certain number of subjects of the Empire of Japan also came to the US and its territory, Hawaii, precisely with ill intent.
Really...My Governor is Maggie Hassan and she is as liberal as they come and said New Hampshire isn’t accepting refugees either. True, she is running for the Senate but still. The federal government needs to understand most Americans do not want these people here.
