Donald Trumpâs high standing in the polls is attributable entirely to the fact that heâs not a Washington insider, not part of the racket, and despite his wealth really might actually give a damn about the Little Guy. So why is he saying things like this?
Donald Trump on Wednesday defended government property seizures as a ânecessary thing,â even when it means involuntarily taking property from a private owner to transfer it to another business. Trump was speaking to reporters outside the capital statehouse moments before formally filing his candidacy for the February primary, and the Washington Examiner pressed him on his record of using eminent domain laws to expand his casino empire.
âProperty rights are a big issue in New Hampshire,â the Examiner noted. âIn Atlantic City you used eminent domain laws aggressively to expand your casino.â
Trump interjected by calling this a âstupid questionâ before launching into a defense of eminent domain. âI am all for private property rights,â Trump said. âThereâs nobody who wants property taken away less than I do, believe me. I would lose a lot of money if my property were taken away. But when youâre building a road, when youâre building a highway, when youâre building whatever it is youâre building from a municipal standpoint, you may need a corner of a piece of property.â As he said this, he pinched his fingers together to demonstrate the smallness of the property.
The abstract reasoning may be sound â although in the Supreme Courtâs disgraceful Kelo decision it certainly was not â but the optics are terrible. It smacks of Romneyism, a cluelessness about how ordinary people live their lives.
Kelo is a nothing-burger.
Presidents appointed the 5 corrupt, activist Liberal “justices” who gave us Kelo. They sound just like Trump’s kind of judges.
Is he a businessman when he is elected president of the United states?
This is just one of several issues I have with the Donald..
Eminent domain being just one...But most of the issues have to do with the tattered constitution and the choice to elect someone who can work to repair it, someone who understands the dire straits we are currently in, not someone who takes advantage of the broken protection and loss of liberty.
They are going to lose this CON. This isn’t even a blip on the politico radar.
He can use eminent domain all he wants to build that damn wall IMO

“The Fifth Amendment to the Constitution says ‘nor shall private property be taken for public use, without just compensation.’ This is a tacit recognition of a preexisting power to take private property for public use, rather than a grant of new power.” Eminent domain “appertains to every independent government. It requires no constitutional recognition; it is an attribute of sovereignty.”

Abuse of eminent domain, such as the Kelo Decisions, should always be fought.
“What is in the constitution is that Government is restricted from seizing property from citizens without due process.”
Without due process? No one has maintained that that is in the Constitution, because it is not. Just the opposite.
5th Amendment:
“No person shall...be deprived of life, liberty, or property, without due process ...”
In other words, death penalty, prison, or eminent domain. Due process of property means restitution by government based on current market value.
Yeah, private property rights are soooo overrated. Any private corporation should be able to seize your land for private use as long as they grease enough palms of local politicians.
Trump did not directly approve of Kelo, but he did give a thoughtful primer on the issue of eminent domain.

Never mind eminent domain is in the Constitution.
He will be to busy taking care of America and righting the wrongs from obuma and Bush...
And with Cruz as his V.P. who can do the Constitution in his sleep, until a slot comes open for Supreme Court where Cruz would be a star at...that is where Trump's whole being will be at...

Among the hard core of Trump supporters, you're right. If they cared about Trump's conservatism (or lack thereof), or his views on the powers of the Federal government, they would have abandoned Trump months ago.
Among the rest of the electorate, you couldn't be more wrong. No reasonable conservative voter would look at Trump's record, Trump's positions (past, present and future), Trump's stated (and unstated) views on government power, and say, "yeah, that's MY guy!" Trump is polling in the neighborhood of ~25%, and has been for months--he's hit his ceiling, and for good reason.
Because Kelo is obviously the most dangerous thing facing the USA in 2015.
Yeah, once people find out about this, his stand on immigration and sending them all home is going to look like a booger.

You’re right. It didn’t come off as Romneyism. It came off as totlaitarianism. Who needs limited goverment? Who needs the Constitution?
I hope he gets flushed for this. It’s statism mixed with crony capitalism. You get the government to take property that’s not yours so you can have it.
