Letter: Put all gun owners in a well-regulated militia

Here's a completely constitutional gun-control measure Congress should consider: Establish a robust national militia, mandating that every gun owner become a member. Failure to register with the militia should result in serious jail time.

In the obvious interest of knowing the quantity and quality of arms available to the militia's purposes, all members should be required to inventory all of their personal arms. Failure to do so should also warrant significant jail time.

Nope- the Constitution is about what government is allowed to do, not about what people are allowed to do.

In other words it is restictive of government.

What this guy proposes may as well be applied to the first amendment and make everyone register in a federal religious database to worship and a federal reporter’s database to talk about the news.

All law-abiding gun owners (and non-gun owners, too) *already are* the militia.

And the 2nd Amendment doesn’t “GIVE” the right to keep and bears. What it really does is meant to restrict the government. Too many forget that, and claim a 2nd Amendment right. That’s dangerous thinking.

Davy Crockett explains partly how the militia worked. When Andrew Jackson was fighting the Indian wars, he needed help, so he asked the men local men to volunteer for thee months. The ones that volunteered brought their muskets. They were not forced, of course, to join, nor was there jail time if they did not.

Crockett, when he was in Congress, had a major falling out with Jackson.

Some reasonable ammendments to Mr Hammer’s plan include:
The Gov must build numerous gun ranges for use by militia members and supply unlimited ammo for their use.
Free training in the use and maintenance of the firearms will be provided free of charge.
To prevent the hearing of militia members and avoid disturbing those living in proximity to gun ranges, suppressors will be legal to own in all 50 states with no NFA taxes or paperwork.
The gov must also provide free firearms and ammo for those unable to afford them but who want to protect the nation and their families. The firearms provided will be functionally similar to those currently in use by the US military.
These would be good “first steps”.

the act of submitting to a form 4473 is in itself creation of a well regulated militia imo - same for the NRA / SCOPE etc any other group

Very true. BTW, I think just about everybody had a major falling out with Jackson. He could, at best, be described as a difficult man.

That would be an “organized” militia contrary to the US Constitution.

In fact, every American ages 16-65 are already in the “unorganized” militia and are not controlled by a centralized US government.

Citizen militias in the second amendment are there to protect us against an over powerful centralized government. Organizing a citizen militia and then registering their firearms is no different than the US government registering and then confiscating every American their private firearms.

No thanks!

Congress never had control over the militia. Thus the term militia instead of army.

(a) The militia of the United States consists of all able-bodied males at least 17 years of age and, except as provided in section 313 of title 32, under 45 years of age who are, or who have made a declaration of intention to become, citizens of the United States and of female citizens of the United States who are members of the National Guard.
(b) The classes of the militia are—
(1) the organized militia, which consists of the National Guard and the Naval Militia; and
(2) the unorganized militia, which consists of the members of the militia who are not members of the National Guard or the Naval Militia.

I always considered each state's national guard as the "milita"...

The national guard is under the control of the state governor...

"A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed."

The liberal hate that comma in the middle...

Otherwise the concept in the article is a really stupid idea...and unconstitutional....

But, since the constitution is just a piece of old parchment to libtards, it's a GREAT idea to confiscate...

An interesting approach.

Only interesting if you're a person who believes that the power of the state should be absolute, and that the Bill of Rights is really a Bill of Privileges that are extended to the citizens by the government and can be taken away by the government for any reason. Otherwise it's supportive of a totalitarian police state.

The 2nd amendment does not REQUIRE you to be in a militia to own a gun, it just says that a militia is necessary to ensure freedom and so citizens should not have the right to own a gun removed.

Note it does not say people should be ALLOWED to have guns, or even grant them the right to (whether joining a militia or not), but rather that people already have that RIGHT and it “shall not be infringed”

NOTICE IT IS ALWAYS LIBERALS WHO WANT TO JAIL PEOPLE WHO DISAGREE WITH THEM
