Done and done: Justice Dept says Hillary Clinton could erase emails if she liked

Prepare to be shocked. Regardless of what turns up in Hillary Clinton’s emails in the weeks and months to come, you won’t need to worry about the Justice Department coming along and dragging the former Secretary of State off in handcuffs. Deleting all of those emails was, in the opinion of the nation’s top cops, absolutely fine and dandy. (ABC News)

The Justice Department is affirming that former Secretary of State Hillary Rodham Clinton had the right to delete personal emails from her private server.

Government lawyers made the assertion in a court filing this week in a public records lawsuit filed by Judicial Watch, an advocacy group. The legal filing says “there is no question” that Clinton could have deleted personal emails without agency supervision and could have done so even if she’d been using a government server.

Some additional coverage at Buzzfeed turns up this nugget. (Emphasis added)

The back-and-forth over the preservation order, as part of a narrow FOIA case, does not address the classification issues that still command sustained political coverage about Clinton.

But in terms of the email submission itself, the lawyers argue that, without reason to believe that Clinton was not honest and forthcoming in selecting and turning over her federal records, no government agency would be required to “recover deleted material based on unfounded speculation that responsive information had been deleted.” Such was the case with Clinton, the lawyers say.

That’s a fairly amazing argument summed up in only a few words. On the one hand they offer a nod to the fact that Clinton repeatedly lied about sending and receiving classified data on this account. (Classified? Why would you think that satellite photos of North Korean nuclear installations were classified?) But in the very next breath they argue that retention of all of the emails to sort out what was or wasn’t of value was not required because there was no reason to believe that Clinton was not honest and forthcoming.

The mind doth boggle.

Say… I wonder if the IRS would be willing to allow me to go through all of my tax documents, decide which ones were “relevant” and just toss the rest in the old burn barrel? I mean, there’s no reason to think I wasn’t being honest and forthcoming, so pesky little details such as those should be left to my discretion. Even more to the point, if something of interest to the police takes place on my property and it’s captured by my security cameras, I suppose I can decide which footage is relevant and worthy of retention. This is truly wild.

I’m sure it’s just my suspicious nature cropping up again, but doesn’t it seem like there are some folks in the Justice Department who prefer to take a decidedly hands off approach when it comes to Clinton? It was only this week when we discovered that they had been handed a case which seemed to clearly argue that Clinton’s aide Huma Abedin was going down for embezzlement, but they decided that prosecuting her would be more trouble than it was worth. One has to wonder just how far Clinton can push her luck before their interests are roused to the point of taking action.

Loretta Lynch TOLD Republican Senators she would enforce only laws that she likes, and vice versa.

Obama hates her. She is being slowly pushed under the bus to make way for Biden. They have to do it carefully to avoid stopping the Clinton gravy train. Zero and Jarret are the ones that need to go first, followed by all of Zero’s bench appointees.

Two points:

Point One: Isn’t it possible certain selective FBI agents, loyal to America their country, are intentionally dragging their feet on Hillary in the hope that “helps on the way” in approximately 13-14 months?

Point Two: I’ve always preferred a wall of separation between DOJ and the Executive Branch. Practically speaking, I guess a scenario sort of like the FBI where it’s head is appointed for a ten year term (I think)????

Did Obama’s DOJ do this to show Hillary it has her back. When the real crimes emerge regarding the classified stuff, they can tell Hillary they are sorry but there was no choice.

I hope so. This hardcore corruption is mind boggling.

This is why we need a President Trump. We’ve lost the USA but most of our people, or at least half, still have the American spirit. Someone like Trump is our only hope.

“Justice Department simply affirmed a person has the right to delete “personal” emails on their own private account/server.” That “rule” does not apply to positions like heads of departments that must be confirmed. Those records must be maintained. This is more word play from Hillary and DOJ.

Got the "all clear" sign just in the nick of time. The Clinton Foundation gets ready to party.

Hillary Clinton to Skip Clinton Foundation Meeting This Year / by Matt Rivera, nbcnews.com

Hillary Clinton will have no formal role in this year's Clinton Global Initiative, the glitzy philanthropic gathering organized by her husband and the charitable foundation he started. The former secretary of state played a large role in last year's CGI meeting, speaking on panels, participating in interviews, and appearing on the main stage with her husband and daughter. But this year's meeting, scheduled for September 26-29 in New York City, will be down one Clinton.

"Secretary Clinton doesn't have a role in the CGI program or a speaking role this year," Clinton Foundation spokesperson Craig Minassian told msnbc. Minassian noted that Clinton similarly did not have speaking role at CGI during her last presidential run in 2007. CGI has typically invited the nominees of both parties to the main stage during general election years. But it has not featured primary candidates, except for sitting presidents running for re-election, who are always invited.

Clinton joined the Clinton Foundation after stepping down as secretary of state in early 2013, but resigned her seat on the charity's board shortly after declaring her presidential run in April. She and her husband, former president Bill Clinton, faced scrutiny and allegations of conflicts of interest related to their work for the foundation earlier this year. The charity has collected multi-million-dollar checks from wealthy individuals and foreign governments, some of whom may be seeking influence with a former president and potential future one.

When Hillary Clinton joined the Obama administration in 2009, the foundation agreed to disclose its donors and limit foreign contributions. It's unclear what would happen to the foundation if Clinton becomes president. "Right now, she's separated from the foundation," Clinton campaign chairman John Podesta told "Meet the Press" in June. "I think that, as she did as secretary of state, she'll put in place anything that's appropriate to make sure that the work of the foundation, which has been excellent across the country and across the world, can continue, but without any question about undue influence."

Since its founding in 2005, CGI has leveraged Bill Clinton's star power to convene more than 190 sitting and former heads of state, more than 20 Nobel laureates, and hundreds of CEOs and philanthropists. Participates make pledges for charitable actions around the world.

On hand this year will be billionaire financier and Democratic megadonor George Soros, businessmen Bill Gates and Richard Branson, and actress Charlize Theron, along with the head of the World Bank and the CEOs of Alibaba, Unilever, and Monsanto.

Timed to coincide with the annual meeting of the United Nations General Assembly, CGI also attracts many foreign leaders. This year's participants include the prime minister of Italy, the queen of Jordan and the sitting presidents of Iceland, Croatia, and Sri Lanka, among others. The event will also feature former heads of state or government from Israel, Australia, Mexico, Malawi, Costa Rica, and Georgia.

And they know for certain that there were only personal emails deleted? Well, I suppose they have Hillary’s word on that. That settles it.

"Point One: Isn’t it possible certain selective FBI agents, loyal to America their country, are intentionally dragging their feet on Hillary in the hope that “helps on the way” in approximately 13-14 months?"

That's a possibility for the FBI and other agencies. I doubt it.

"Point Two: I’ve always preferred a wall of separation between DOJ and the Executive Branch. Practically speaking, I guess a scenario sort of like the FBI where it’s head is appointed for a ten year term (I think)????"

The Department of Justice was originally meant to be autonomous from the WH like the Government Accountability Office (GAO) and the Congressional Budget Office (CBO) for Congresss. However, all are appointed by their respective branches. My biggest concern is the life-long appointments to the USSC. The Founding Fathers' could never have seen how that branch would be so abused, much less the other two branches.

Obviously, the DOJ has become so politically motivated since Clinton, . But the GAO and CBO are still non-partisan and often put out negative studies that the MSM doesn't report. The Inspector Generals of various departments/agencies are sometimes forthcoming, depending on which organization and who is loyal to whom.

I completely agree with term limits for any fedgov, stategov, localgov representative. That's the only cure but they will never limit their power. I've been promoting term limits for 3 decades. It was a main principle of Veterns for Constitutional Restoration (VetsCor). I would give 2 four year terms for Senators and 4 two year terms for House Reps.

Power corrupts. Since the Legislative branch and the Judicial Branch have unlimited terms, power currupts absolutely. Thank god for the Amendment XXII that limits the president to two terms. If not for that, we would have been a dictatorship after Roosevelt.
