This was the whole strategy behind President Obama's decision to declare the Iran accord an "executive agreement" rather than a treaty. Treaties require two-thirds support from the Senate for adoption; executive agreements, Obama has argued, don't require any vote at all. Ultimately, even Congressional Democrats were unwilling to accede to a power grab quite that brazen, especially on a deal with major geopolitical implications and that is intended to bind future presidents and Congresses. Thus, a bipartisan bill was passed that asserted the right of Congress to vote to approve or disapprove the final agreement. But with Obama's veto pen waiting in the Oval Office, derailing the deal would take a veto override -- two-thirds majorities in both houses. So the whip count math was flipped on its head: Rather than the White House needing to find 67 Senators to bless a treaty, they only need one-third of at least one house of Congress to sustain his veto of a disapproval resolution. That's a much, much lower bar, and one that Democrats are ready to clear:

They put on a good act for the folks back home. Now they can say they did all they could to oppose the deal.
Is the power to negotiate an “executive agreement” by POTUS in the Constitution?
dear detective,
re: “Is the power to negotiate an executive agreement by POTUS in the Constitution?”
No.
1/3 of the Congress hates American security, hates Israel and loves the Mullahs.
Foul.
I can’t get out of my head that somehow The Emperor is blackmailing the GOP congressional leadership, and certain key Dems which might have otherwise voted the other way.
Medellín v. Texas, 552 U.S. 491 (2008), is a United States Supreme Court decision that held that even if an international treaty may constitute an international commitment, it is not binding domestic law unless Congress has enacted statutes implementing it or unless the treaty itself is “self-executing.” Also, the Court held that decisions of the International Court of Justice are not binding domestic law and that, without authority from the United States Congress or the Constitution, the President of the United States lacks the power to enforce international treaties or decisions of the International Court of Justice.

Michigan currently has sanctions against Iran based upon this precedent. (Thanks to Texas Solicitor General Ted Cruz)
Obama and Kerry may have betrayed the country, but it is the Republicans who are ultimately to blame, because they could have stopped him and yet intentionally decided not to do so, but only to pretend.
Bob Corker is a jackass..and needs a primary in 2018
Thanks to the GOP leadership, the Constitution got turned upside down. Of course one might challenge that the legislation in question is unconstitutional , but then we would be disappointed to find out in an Obama court that none of us have standing except Obama.
I for one have thoroughly enjoyed this episode of GOP Kabuki Failure Theater. The performances, the choreography and the set design were all first rate!
It’s a damned TREATY and all treaties must be PASSED by 2/3 of the Senate. Obastard doesn’t get to just sign a treaty and declare it passed! WTF is wrong with the GOP?
The supine and timorous behavior of the leaders of the Republican "opposition" is a major reason for Donald Trump's popularity.
Ted Cruz wrote about this same tactic in his book. It’s the same thing they did during the budget talks he didn’t support.

Hang them all and start with Corker
THIS COMMENT should have the same amount of “LIKES” as there are members of this forum. Minus of course the closeted progressive/liberal/neo-communists.
Ezekiel 38 shall come to pass, exactly as prophesied, in the Latter Years (verse 8) and the Latter Days (verse 16).
You can be 100% assured it is going to happen - I think we’re seeing why.
Part of the deal gives Iran around $170 billion in cash (previously frozen assets).
It will take years to unravel which congresscritter is lining his pocket with this, but I’m sure that’s what’s behind this.
Good stuff, that’s good to know.
