Mark Levin said on "Hannity" tonight that the 14th Amendment does not give citizenship to children of illegal immigrants who are born in the United States.
He said that those claiming that the 14th Amendment allows birthright citizenship are dead wrong, ...
Levin explained that means that Congress - not the president, the courts or U.S. Immigration and Customs Enforcement - has the power to regulate immigration in this regard.
"Of course Trump is right and Cruz is right and Sessions is right. They're all right," Levin said.
"If you want a policy of open borders, that anybody born here should become a United States citizen, you amend the Constitution. We don't have to amend the Constitution. It says what we say it says," Levin stated. "By statute, going forward, prospectively, Congress can in fact say ... 'No, you cannot make children of illegal aliens American citizens automatically.'"

I have heard no more on this and maybe Trump can finally tell us if this is true and they did find something...
Oh Trump did something. He pretended to be interested in a topic that was supported by a plurality of the conservative base, and he did so at little cost to himself.
I was suspecting he was going to run for President way back when he was making noises about being interested in the topic of Obama's legitimacy.
If he wins, he might throw us a bone by ordering investigations into Obama's background. Perhaps we'll finally see the things which have been hidden from us.
More like he'll just ignore the topic when it no longer serves any purpose for him.
Do you mind telling that to those who said yesterday that even Stare Decisis on this case is a bunch of baloney and rendered by judges that were incompetent and uneducated?
BTW, good luck with the political suicide of arguing for the retroactive stripping away of citizenship from those born to illegals on U.S. soil even 5 days ago much less 50 years ago.
And good luck with the political suicide the GOP will suffer if it goes down the road of saying they never possessed citizenship in the first place.
As soon as you drop your daily TDS threads.
So you would argue for sending the GOP down the road of retroactively stripping away citizenship from those born to illegals on U.S. soil, be it 5 weeks, 5 years or 50 years ago?
Insanity. Political suicide for the GOP.
Good luck arguing for that and saying the papers they have possessed for 5 years or even 50 years were never good to begin with.
You will send the GOP to a political grave if you and others argue in favor of that.
Naw, no political suicide, but looks to be GOPE suicide in bunches.
Check the scoreboard lately?

Actually, I wouldn’t shed a tear if the GOP committed political suicide.
However, legislation like this is not retroactive. You simply STOP the anchor baby exception. That doesn’t mean that those recognized as citizens in the past are no longer citizens. Ex post facto punishment for what was legal prior is not the American way. Art I, Sect 9, para 3: “No Bill of Attainder or ex post facto Law shall be passed. “
Childern of foreign diplomats born in the US are not US citizens. This is not allowed by law. They same law could include foreign nations as a whole, illegally and/or legally in the US at the time of birth. This is what is meant by the jurisdiction clause of the 14th amendment. What cannot happen is to retroactively remove citizenship. This would be an ex post facto law, which is not constitutional.
Yes,I did see that part of the show. He probably went home alone and enjoyed himself alone!
But Judge Napolitano and of course that genius, O’Reilly says that he’s wrong.
1. Leave and take any minor children with them.
2. Leave and make verifiable arrangements to leave their Anchor Babies with a US citizen guardian that will provide for them until age 18.
3. Anchor Babies become wards of the state and can be emancipated after age 16 if they can prove they are self supporting.
Mark is absolutely right.

Repeal Simpson-Mazzoli.
Yeah these 'geniuses' are way behind the power curve. You don't give the history of US citizenship and the issues behind it a superficial look and then think you know it. Many of us here, on FR, as you know, have been studying this issue on and off for a very long.
Exactly, along with the lack of transparency regarding Obama’s birth, college work, law school work, travels etc.
Then you have someone like Trump who is totally transparent.
Where were the “illegals” from Europe “50, 70, or 90 years ago” that you are talking about? Immigration to the U.S. from Europe historically was a tightly controlled process by the U.S. government with quotas and entrance requirements. We have NEVER had anything LIKE the lawlessness of what has been occurring on the southern border since the late 50’s due to the federal government’s total abdication of its enforcement responsibilities on immigration law, and Ted Kennedy’s abominable legislation opening the doors to illegality, in the entire history of this country. You sound like a mouthpiece for LaRaza, spewing historical distortion to further the hateful destructive agenda of that group.
Talk about going for the jugular!
So to add context for reference in post #19 about Brennan.

“As the Supreme Court said in Elk: “[N]o one can become a citizen of a nation without its consent.”
The anchor baby scam was invented 30 years ago by a liberal zealot, Justice William Brennan, who slipped a footnote into a 1982 Supreme Court opinion announcing that the kids born to illegals on U.S. soil are citizens. Fox News is treating Brennan’s crayon scratchings on the Constitution as part of our precious national inheritance. “

The burden of proof as has has been placed upon people who oppose existing policy in fact belongs placed upon those who advocate for it.
