Mark Levin has done a whole show today on birthright citizenship. This would be the 8/18/2015 show. He made it very clear that birthright citizenship is not in the constitution or protected under the constitution for foreigners. He went into the history of who has the right to citizenship as defined in the jurisdiction clause of the 14th amendment . He also goes into the fact that congress has the right to define who gets citizenship under article 1,section 8. This discussion is very very specific and shows that this mess is a failure of congress to act and nothing more.
It is an outstanding briefing if you are all confused.

Congress has no such power. Article 1, section 8 authorizes Congress to establish a uniform rule of "naturalization," which is narrower than citizenship. 14th amendment birthright citizenship is not "naturalization," so Congress's power under Article 1, Section 8 is irrelevant.

You are operating under the misconception that the plain meaning of the Constitution has any relevance whatsoever. We no longer live in a Constitutional republic. We are subject to the dictates of an unelected oligarchy of 5 Supreme Court Justices.

There was no conflict until the court became involved. If you listened to the first hour of Levin today he read verbatum the author of the citizenship porvision of the 14th Amendment.If it didn not cover the Indians or any one else not under the juristiction of the US government (the illegals) there is no case to be made for birthright citzenship for noncitizens
I did listen, and I disagree with him. Instead of throwing his credentials in my face, why not tell me why you think I’m wrong and he’s right?

Listen. If Obama can get away with everything he has, a Trump can also and fight like hell. If we actually started fighting you would be amazed how far we would get.
The problem is everyone is an expert and they all know why it is impossible and all is lost.
You would be amazed if we started fighting how much we could win.
I would not be surprised if it was a dual citizenship scenario.
I would like you to educate me based on your knowledge and experience of the law and the constitution. If you have none of these then you are simply bloviating opinion and nothing more. You are just telling everyone to raise the white flag and give up.

I don’t know. That’s a question of Mexican law. Which means it’s irrelevant to the question of whether that child, if born here, is a U.S. citizen - last I checked, whether a person is a U.S. citizen is not dependent on foreign law.
To illustrate, here’s another hypothetical. Suppose Mexican law stated that if a child has at least one grandparent who is a Mexican citizen, then the child is born a Mexican citizen as well. Would that mean that anyone with a Mexican grandparent would NOT be a U.S. citizen? Of course not, because Mexican law has no bearing on U.S. citizenship.

If you took time to listen to the show, you would know that under Mexican law regardless of were a child is born, as long as the mother is Mexican is automatically a Mexican citizen. So the kid has both Mexican and US citizenship.
Well, I am an attorney, admitted to practice law in New York. So, yeah, I am qualified to read and understand the plain language of the Constitution and applicable Federal law.
Again, don’t just say “BS” and tell me that Levin must be right because he knows things. If you think I’m wrong on the law, then go ahead and tell me what you think I got wrong and why.
