AKRON, Ohio — Police have charged an Akron man with voluntary manslaughter after he allegedly shot and killed a home invasion suspect earlier this month.

According to a release from Akron police, David Hillis, 21, of Hilbish Avenue, was arraigned Monday morning in Akron Municipal Court and then booked into Summit County Jail.
He’s accused of shooting and killing burglary suspect Marcus Glover, 25, of Akron, on Aug. 7.
A second burglary suspect, who police say was with Glover, has also been arrested.
Terry Tart, 37, of Akron, faces charges of aggravated burglary and murder....

I’m not sure what’s going on here a sheriffs deputy was also arrested for just showing up and making a scene it’s very confusing who knows what really happened we need more information
Hillis then pulled a gun, and fired shots as Glover and Tart were running away, police say. Glover was killed.
With the exception of the state of Texas, and even then only at night, you cannot shoot at a fleeing suspect and not expect to be charged.
If the suspects were pointing their guns behind them, then the homeowner Hillis was justified in using deadly force believing his life was in danger, but if the suspects were simply trying to get away, the homeowner is in trouble.
Shot the gun wielding thug, good.
Shot him in the back? Seems to depend on the state it happens in and the prosecutor

I guess the charge arises from the fact that the blacks were running away at the time of the shooting. My opinion being once in the house by means of a break in the burglar is a dead man. A person lawfully in possession of a house should have the right to shoot the intruder whether he is running away or not(fleeing felon rule). The authorities are actually favoring the criminal element by such conduct as exhibited in this article.

What the hell is the matter with these prosecutors. They all are scared by the BLACK LIVES MATTER movement which wants to make it illegal for Whites/Asians/Hispanics to defend themselves when attacked by blacks IMHO.
Self Defense against black attackers is becoming VERY effective...we can’t have that, can we?

You may defend yourself in your home and in fear for your life. However, you can't pursue an assailant outside and chase him while firing multiple shots.
The defendant got a bit too enthusiastic for his own good...

That is what we need; the jury needs to find him not guilty.
But the cops and the DA had press the charges and enforce the law as it exists. You can’t shoot at a fleeing perp (in most states).

I think not, the guy is innocent, well done in a just world.
The problem is, as a matter of law, when the perps are fleeing they are no longer a threat nor an intruder. If you have exhibited a weapon to scare them off, you have achieved your goal of self defense. Pursuing them then killing them is in a whole different category.
I'd like to agree with the poster above who wrote once they enter you home they are as good as dead, but in good conscience I can't.

That would be a good argument for a lawyer to make that he still feared for his life, especially since there were two of them and they were also armed. But he likely gave a statement to the cops that didn’t indicate he feared that. Which is why all you should say is “I shot an intruder in self defense.” and wait for a lawyer.
