The Department of Justice argued in a brief to a federal court on Monday that transgender high school students should be able to use school restrooms that match up with their gender identity, and can't be forced by the school to use the restroom that matches up with their physical characteristics.
It's the first time the federal government has tried to make the case for this transgender right in a courtroom.
Justice's Civil Rights Division filed the brief on behalf of Gavin Grimm, a Virginia high school student who identifies as a boy, even though Grimm was born female.
"He was assigned the female sex at birth, but his gender identity is male and he presents as a boy in all aspects of his life," Justice wrote in its argument to the U.S. District Court for the Eastern District of Virginia.
Grimm was allowed to use the boys' restroom for seven weeks, until Gloucester County Public Schools imposed a policy that barred Grimm from the boys' room. The school made that policy because Grimm is not "biologically male."
But Justice said Title IX of the Education Amendments, a law aimed at ending sexual discrimination, holds that the school's policy change is illegal.
"Under Title IX, discrimination based on a person's gender identity, a person's transgender status, or a person's nonconformity to sex stereotypes constitutes discrimination based on sex," Justice wrote. "As such, prohibiting a student from accessing the restrooms that match his gender identity is prohibited sex discrimination under Title IX."

That’s what I noticed. Assigned? You mean, the baby had no genitalia and they assigned it a gender? Or did the baby have female genitalia, but the patriarchal OB/GYN insisted on identifying him as a female?
Sex is not assigned - not ever. Sex is determined at conception, and doesn't change afterward.
When I was a worker’s comp case manager, if a client of mine said they encouraged-or just supported-their minor child in acting out being the opposite gender-even though it didn’t have a damn thing to do with a workers comp claim, my employer required that I inform him and report it as child abuse. It still is child abuse-actually resembles Munchausen by Proxy...

Who would go in a bathroom used by males if they didn’t have to?
People with gender identity problems are delusional, severely neurotic, some are even psychotic.
These people should be seeking therapy and should be medicated.
Some of them should be locked up.

They should not be allowed to mix it up with tender children in public bathrooms.

Tell me that a whole bunch of junior high school boys who want to try to see a girl’s panties or the bra of some 14 year old girl adjusting her clothes, or shower with the girls after gym class aren’t going to “self-identify” as a female for about 5 minutes after 4th period Social Studies at the local junior high school!

Ive seen them there and taken my granddaughters back out until they were gone, speaking loudly to the idiotic female about the situation at the time..(and getting rude words back as in I’m the evil one)

If the government is doing something that seems utterly insane, either “Obama is homosexual,” or “It’s a Commie plot,” is a reasonable explanation.
The absolute stupidity of liberals is stunning. The justice department needs to be party to being sued along with the school system they demanded let this happen, when the inevitable happens and someone is seriously damaged.
This is another 17th Amendment-related issue since the USAG is confirmed by the Senate.
Just as with gay marriage and abortion, the states have never amended the Constitution to expressly protect so-called transgender rights. So the Justice Department has no constitutionally enumerated protections concerning these issues to apply to the states via the 14th Amendment imo.
The states have also never delegated to the feds, expressly via the Constitution, the specific power to decide policy for intrastate schools. So the Justice Department is evidently once again trying to use constitutionally nonexistent federal government powers to win votes from low-information voters.
The 17th Amendment needs to disappear, along with corrupt senators and Constitution-ignoring attorney generals.

use which ever you want to. Gender is fluid and you can change day to day? Build individual bathroom stalls , like port o potties.
