I actually agree. When it comes to food and drink, there needs to be some safeguards to insure that the products are safe to consume. Then what about bake sales?

Two young sisters with an "entrepreneurial spirit" set up a lemonade stand in Overton, Texas, to raise money for their dad's Father's day gift, their mom said.
But Andria and Zoey Green's business closed abruptly Monday after police came by to tell them their stand was illegal without a city Peddler's Permit, according to Overton Police Department Chief Clyde Carter.
"It's illegal to sell lemonade without a permit," Carter told ABC News today. "But we didn't tell them to shut down, we just asked them to get a permit."
The girls' mother, Sandi Evans, said they went to try to get a Peddler's Permit at City Hall, but found out they'd have to get licensed by the Rusk County Health Department before being allowed a Peddler's Permit.

"Once we found out everything we would have to go through, we just decided to stop technically selling the lemonade," Evans told ABC News today. "The girls are still going to have the stand, but they're just going to ask for donations instead."

Clyde and his goons like to bully little girls. I guess if you're under-endowed you have to do stuff like that to feel good about yourself.
A learning experience for this family, perhaps grade schools should devote a few days to teaching local city ordinances and where to look them up. And invite new city residents to the class.
I disagree. For one thing if you ask for donations, you don’t have to file income tax later on. Donations is a better way to go. I wonder if these parents of the little girl have any business sense at all.

Sure. Choke out any signs of capitalism in the youth of today who will be the adults of tomorrow. Teach them that the government decides everything and you can’t do ANYTHING without permission from the authorities. THAT is the FUTURE of America.

I would agree. I've heard of a number of cases where this worked out well. My favorite (this is a true story):
There is an island off the coast of Maine. Tourists like to visit, but they don't always pay to have their car brought over on the ferry. Fortunately, there is a taxi service on the island which -- for a small fee -- will drive people where they want to go. Now, the taxi service wasn't making money, so the state of ME began to subsidize it. Between the state subsidy and the paying customers, the taxi company stayed in business. But then it happened:
Some college kid starting to drive people around. He didn't have a state permit to be a taxi (no subsidy for him!) so he could not legally charge people. But he drove people where they wanted go, and simply asked for donations. He was making tons of money because people were generous. The subsidized taxi company almost went out of business because they lost so many customers. "Fortunately" the subsidized taxi company was able to get friends in state government to shut down the guy who took donations. His "free" service was considered unfair to other businesses.
True, but you’re describing a way to skirt the existing local law. I’m saying the law shouldn’t be there in the first place, this being America and all.
Beside, minors selling a few dollars of beverage are required to file income tax in Texas? Or do you mean Federal taxes?
What happened to the Lone Star State? Even New York State, as communist as they are doesn’t require minors to do that.
On second thought, I don't agree with any of it in this case. I was thinking more generally when it comes to selling open food and drink. It's risking enough buying food from venders who HAVE a proper permit, especially here in New York City.
Just because it’s illegal doesn’t mean it’s wrong.
