Two young sisters with an "entrepreneurial spirit" set up a lemonade stand in Overton, Texas, to raise money for their dad's Father's day gift, their mom said.
But Andria and Zoey Green's business closed abruptly Monday after police came by to tell them their stand was illegal without a city Peddler's Permit, according to Overton Police Department Chief Clyde Carter.
"It's illegal to sell lemonade without a permit," Carter told ABC News today. "But we didn't tell them to shut down, we just asked them to get a permit."
The girls' mother, Sandi Evans, said they went to try to get a Peddler's Permit at City Hall, but found out they'd have to get licensed by the Rusk County Health Department before being allowed a Peddler's Permit.

"Once we found out everything we would have to go through, we just decided to stop technically selling the lemonade," Evans told ABC News today. "The girls are still going to have the stand, but they're just going to ask for donations instead."

Ronald Reagan made a sppech in the late 60’s or early 70’s.
He talks about when he was a kid he could just go and do just about anything for money to go to college. And he did.
But then he goes on to say how virtually anything a youngster wanted to do to raise cash for school he needed ‘permission’ by some bureaucrat. A license, a permit, a waiver...something. As a result, many kids don’t get to make the money they need for school (or whatever the need is).
RR closes by warning us about losing our freedom. He said something to the effect of: if you don’t preserve and protect it in your own generation, you’ll be telling your grandchildren what it was like in America when men were free.
I see his warnings were not heeded.
Kids need to learn early that government control everything they do.

It's illegal for a BUSINESS to sell lemonade without a permit. It is not illegal for two girls to sell lemonade without a permit.
No, they are not a business. No it does not matter if they are selling something. A business is an incorporated entity, or a person or individual representing an incorporated entity. They are neither - they are conducting sales
However, the police are empowered to presume corporate status, and have therefore challenged them to refute that presumption. As they have not refuted that presumption, therefore the police can operate against them as if they agree to the presumption that they are an incorporated business.
So all they have to do is refute the presumption through a declaration of their non-corporate status, and challenge the town to prove their presumption of corporate status, and the police will go away and the town will leave them alone.
Right?

And not even have to collect sales tax and hand it over. Hell most work for cash under the table and on’t pay inome tax either...
In all due respect to you, I beg to differ. I don’t think this is much ado about nothing. Not at all.
It strikes to the heart of the freedom to pursue life, liberty, and happiness, and other Constitutionally protected liberties.
I am not blaming the police. If there’s a law prohibiting ‘peddling’ without a permit, then there’s a law. The blame goes to the city council or county government.
You and I cannot wake up without violating 3 laws or regulations.
