A Raleigh, N.C., police officer is suing Starbucks for $50,000 because he says he spilled a free coffee in his lap and burned himself.
WRAL-TV reports Lt. Matthew Kohr suffered burns, blisters and emotional damage after the spill in 2012., his lawyers told court Monday.
Kohr claims the lid popped off the coffee and the injuries he received aggravated his Crohn's disease. He says he had to undergo surgery to remove part of his intestine.
The suit also alleges Kohr's wife, Melanie, as a result of the burn, suffered a loss of "emotional support, her social companion and her intimate partner."
Starbucks lawyers told court Kohr isn't subject to the same warranty because it was a free coffee, according to WRAL-TV.
The allegations haven't been proven in court.
Jury selection is underway and testimony is scheduled to begin later this week, the report says.
True, but as this is a case against Starbucks I’d like to point out that I have drank coffee from Starbucks all over the country and one thing I like about their coffee is that its not served so hot that its not drinkable. That is just my experience though. One thing I don’t understand is how spilling coffee on oneself can result in blisters bad enough as to have a section of a intestine removed. I’m not “nay saying” just wondering if someone can shed some light on that for me.
If you saw the evidence photo of the McDonalds lady, you wouldn’t think her suit was frivolous. (way too graphic to post here)
3rd degree burns hurt like HELL. And I can’t even imagine burning all your genitals...
Mother served coffee screamin’ hot, black and strong enough to stand a spoon up in.
No doubt, that's why you should be careful with coffee, but still I don't see why that's McDonalds' fault. Coffee is hot, who knew?
Common sense hasn’t been taught correctly since all this sue-happy crap started. I swear there are people in this country to who nothing but look for accidents waiting to happen. I wonder how many people have purposely dumped coffee on themselves to try and make some money. Same with the parents that sent their kids to stay the night with Michael Jackson. They knew what they were doing all along. Makes me sick.
Hero!
140 degree water is enough to cause light burns with a glancing touch and too hot for a faucet. Your hot water at home is no more than 120 (typically 110).
She spilled 190 degree water on her crotch and it stayed in her clothes for a minute...
Why was this cop’s coffee free?
Fact. Someone else had to pay for her doing a stupid thing to herself.
Fast. Since then coffee has been served at a temperature that could be best described as "tepid".
Hmm. I had surgery to remove part of my intestine last year too. I wonder who I can blame for it and make some cash?
Yeah, I don’t know about the merits of this case, but there’s a lot of people who hold up the McDonald’s case as some egregious case of tort abuse without knowing all the facts.
190 degrees is far above any reasonable temp and even the most careful people can spill(especially when the cup burns hands on contact). It only becomes drinkable below 140 anyway.
I know a few people want their coffee extra hot to save for later. They can have the server pop it in a microwave if they want it near boiling
OH...MY...GOD...I seriously take back everything I said about that woman. I looked up the pictures and nearly threw up. I had no idea it was that bad. Just wow...
Coffee is typically served at about 165 degrees. The McDonald's coffee was at 190. It's the difference between second degree and third degree burns.
To all of those who have seen my posts about the lady who spilled the Mcdonalds coffee on herself, I take back anything that I said that sounded at all as though she did not suffer. I googled the photos of her burns and could not believe it. I had no idea it was that bad. Those are some seriously heinous burns she received. I actually retched a little when i saw them. I apologize sincerely.
If something isn’t too hot to drink, I’m at a loss to figure out how it can do severe damage to other parts of your body.
Is it good for people to drink something that hot? I sometimes wonder about the long term effects.
Thank you for posting the truth about that McDonald’s case. She was severely hurt—I had no idea. That part really got lost in the reporting of the story.
Coffee is hot. Good coffee is brewed at 200°F. People want coffee, good coffee, and they know it will be hot, know (from experience!) they must wait for it to cool down or they’ll burn themselves on it.
Ya know, sometimes people want things which are dangerous. They know it’s dangerous. It’s not useful/desirable if it’s not dangerous. No surprise that a few people out of millions subsequently get hurt.
