Key Witness: Prosecutor Manipulated Me Into Falsely Testifying Against Scooter Libby

Judith Miller, the former New York Times reporter, has blown a big hole in the case against Lewis “Scooter” Libby, convicted of lying to avoid blame for outing a CIA agent. Miller was a key witness in Libby’s trial, but in her new book she has repudiated her testimony.

Libby was “railroaded in his conviction” by Special Counsel Patrick J. Fitzgerald, she said in an interview on Fox News yesterday.

In her book, The Story: A Reporter’s Journey, she writes that Fitzgerald cajoled her into testifying in 2007 that Libby had told her Valerie Plame, the wife of a critic of President George W. Bush and the war in Iraq, was a CIA officer. This undermined Libby’s own testimony and contributed significantly to his conviction for obstruction of justice, making a false statement, and perjury.

“I was the only reporter to state that Libby had discussed Wilson’s wife,” Miller writes. Wilson, a retired diplomat, had been sent at his wife’s suggestion to Niger to find if Iraq officials had sought to buy uranium there. Wilson said they hadn’t, thus disputing what Bush had said in his 2003 State of the Union Address.

“So my testimony, Fitzgerald said in his closing arguments, was crucial to the case against Libby,” according to Miller. “It was also crucial to Fitzgerald’s assertion that the vice president had been involved, since Libby had told the grand jury that [Dick] Cheney had approved his suggestion that he discuss the intelligence estimate about Iraq and WMD with me.”

Not necessarily.

I belive that Libby can now file to have his conviction overturned due to prosecutorial malfeasance. Like Ted Stevens did.

In fact, having his sentance commuted rather than being pardoned by Bush works to his advantage here. AND it opens the door to a direct suit against Fitzgerald.

She’s claiming that she was tricked into unknowingly providing false testimony. Which is different than lying under oath/perjury in an act of commission.

The responsibility here lies on the prosecutor, not her.

The statute of limitations for perjury on the Federal level is three years.

Libby was fined $250,000, and as a convicted felon, he has been disbarred from practicing law and cannot vote.

Correct. He can now sue to have that conviction overturned and his rights restored.

He can also go after Fitzgerald for all sorts of damages. Think of Fitzgerald as Gaelic for “Nifong”

I wonder if Fitz threatened her about what would happen if she refused to interpret “Bureau” the way he wanted. He’s pond-scum either way, and I hope he gets taken to the cleaners.

Oh, no it doesn’t preclude her from responsibility.

She only now deduces that she has been “tricked”? Only now after the statutes of limitations has been effected? Only now with a book advance under her belt, and more big money to come? She should have been kicking and screaming on behalf of her book’s protagonist long, long ago, before it was profitable, before the statute of limitations.

This woman was on CBS Morning show today with Charlie Rose and the associate women hosts and there was no mention of Scooter Libby, just the subject of how Bush, and particularly Cheney, were mad-dog War Mongers and led America into an illegitimate war.
