Please explain the right tool then.

Police across this nation are sent out on missions like this every single hour.

Your vision is not quite 20-20.

The officer failed to acquire consent to enter; he was an unlawful intruder.

Murder one, open and shut!

No one could enter his house?

So then a guy who lives alone in his house and who dies will forever be left in his house, because nobody could ever enter it.

Got it.

The investigation found the officer was following department procedure.

That is your job. If you are not close enough, make the arrangements with others in advance.

“————————presumably entertaining fellow officers with the story of how he shot this old man to death in his own home because the old boy couldn’t seem to follow instructions”

You’re sick.

The police are not mental health counselors, marriage counselors, rehab counselors, family coaches, anger management mediators, bed-checkers, dietary managers, or clergy in a pinch.
If you have a loved one with any of the above conditions, please make alternative arrangements for their wellness beyond calling the po-po.

Your loved ones and family are your responsibility, not a 911 dispatcher’s and certainly not anyone carrying a gun!

I’m saying it is not the job of the cops to check on your uncle or grandpa. That is your job. If you are not close enough, make the arrangements with others in advance.

Certainly if the next of kin is near by then they should be the first on the scene to enter the house and even break in if they have to.

Perhaps the next of kin wan't near by.

So they called the cops who then called the fire department and EMS.

Perfectly reasonable.

His family could not contact him. He was home. What does that tell you?

That he didn't feel like answering the phone? At my house, it's my phone and I pay the bill; if I don't feel like answering it, I don't have to.

Folks, there's only one logical conclusion to draw... unless there's no alternative, whatever you do, DON'T CALL THE POLICE!

So then if an old guy who lives alone dies in his house, how does that old dead guy wind up being found?

According to you, he would never be found, because nobody is allowed to enter the house.

Enter between 0900-1700

If you asked the police to check on your father, because he was elderly and may be in medical duress, would you consider it a reasonable response for the police to knock on the door and walk away, after having received no answer because they didn’t want to violate his Constitutional rights? What if your father was on the floor and out of sight?

You’ve already established that your father has a condition that puts him at an elevated medical risk. That to me has established the required scream that would allow the police officer to enter the home without a warrant.

"Perfectly reasonable."

Does not end up with a killed homeowner who committed no crime, and a policeman who will now be carrying this around with him for life. The police are not social workers. The "missions" you refer to are supposed to be enforcing laws and responding to crimes, not breaking into people's homes and doing bed checks.

If I go to check on a 74 year old man, and upon entering his home he confronts me with a gun, well, I give up my ground, put my gun away, and my hands up and tell him that I am leaving.

Makes sense to me...Apparently the cop went in with his gun drawn...

We just disagree on what the mandate of a local police force is supposed to be doing. In order to respect the fourth amendment and all the other rights we have to restrict governments(that's what our rights do) you have to assume a large amount of personal responsibility, including your family.

With individual liberty comes a great responsibility. We do not have an ala carte constitution where we pick and choose which rights we want to apply and when. They either exist or do not.
