Gun owners fear Maryland cops target them for traffic stops

A year ago this New Year’s Eve, John Filippidis of Florida was driving south with his family on Interstate 95 when the Maryland Transportation Authority Police pulled over his black Ford Expedition and proceeded to raid it while his twins, wife and daughter looked on — separated in the back seats of different police cruisers.

The officers were searching for Mr. Filippidis‘ Florida-licensed, palm-size Kel-Tec .38 semi-automatic handgun, which he left at home locked in his safe. (Maryland does not recognize handgun permits issued by other states.)

When the search turned up nothing, Mr. Filippidis, 51, was allowed to go and was issued only a speeding warning.

The incident gained national attention. Mr. Filippidis went on multiple radio programs and described in detail how scared and outraged he and his family were. He wondered: How did the police know he was licensed for concealed carry, and what right did they have to search through his personal items on the side of the busy interstate filled with holiday travelers on that 10-degree day?

“My wife’s hysterical, shaking and crying,” Mr. Filippidis recalled in an interview with The Washington Times. “I don’t have a criminal record. I own a business. I’m a family man, and I tried to explain that to [the officer]. But he had a bad attitude, didn’t want to hear my story. He just wanted to find that gun and take me away from my family. That was his goal, but he couldn’t do it, because I didn’t have a gun, like I told him.”

Mr. Filippidis‘ case earned the support of Second Amendment advocates and subsequent apologies from the MDTA. But an internal police review concluded his stop and search were lawful and did not violate police protocols.

North Carolina Concealed Weapons Permit holders are given a recommendation to hold their hands out the window when law enforcement pulls you over; it is a courtesy to law enforcement because your Concealed Weapons Permit is reported to DMV. The flip side is that law enforcement sees Concealed Carry citizens (except for a minority) as partners in stopping crime.

Having a CCW doesn’t waive the gentleman’s 4th amendment rights or serve as probable cause to search his car. I would like to know exactly how this stop went down.

Then “police protocols” and the law need to be changed.

I’ll bet that Bersa Thunder 308 has one hell of a kick. Didn’t know they made that caliber. I’m glad I bought the Bersa Thunder 380.

I go out of my way to transit Maryland on I-81 route rather than on the I-95 Corridor, five or six times a year. It takes me an extra 20 minutes each time, but I want to spend as little time in Maryland as possible. It goes without saying that I don’t spend one thin dime when I’m there.

From reading the South Carolina law on carrying a concealed weapon, I believe it says that if you have an out of state carry permit you may carry it only in your car and it must be unloaded.

In a conservative state, with a conservative governor and Republican legislature it's hard to believe they haven't voted to recognize out of state carry permits. The NRA needs to lobby for that in 2015.

That’s true for most “permit” states in the South I thought.

A smart CCW holder would leave his car at home and rent if they plan on going on a road trip through Commieland Stasi states like Maryland.

Cops look at plates and run the tags to see what they can find (like permit holders).

If he said the gun wasn’t in the truck and then the wife said something different, then there is going to be an issue. The fact that he separated the two for a mere traffic stop sounds like a pretty sketchy fishing expedition.

Perhaps the governor of Florida should issue an executive order stating that Florida will no longer recognize driver’s licenses or marriages from Maryland since Maryland doesn’t recognize Florida’s CC permits.

Passengers in a vehicle that has been stopped by the police are under NO obligation to speak, answer or manipulate the vehicle and its contents in anyway (i.e., roll down a window).

During a traffic stop, the driver would do well to tell passengers, “Don’t say or do anything and keep your hands visible.”

I had a borrowed vehicle stolen this year. I called the police and gave them my name and address. A second later they said that I came back as a CCL and asked if there was a gun in the car.
