Every now and then, news breaks in the Obama administration that is so stereotypical, it is actually depressing. You might want to sit down for this.
Attorney General Eric Holder, made infamous by Operation Fast and Furious, is currently arguing before the Supreme Court that United Nations treaties trump the United States Constitution.
Thats right. The sitting Attorney General, charged with upholding and defending the Constitution, is arguing before the highest court that international law is in fact the law of the land.
The case in question, Bond v. United States, is actually pretty ridiculous. The defendant is charged with using a toxic substance to harass a friend who was having an affair with her husband. Under the law, this case would normally be handled at the State-level. But Federal prosecutors instead charged Bond with violating the Chemical Weapons Convention. This would be like taking a perpetrator of a domestic hate crime and instead charging him or her with genocide.

The UN out of the US. International Law my backside trumping the US Constitution. Holder should be in federal prison than a hearing. Bring him to the closed state prison in Newberry or the Ottawa National Forest work camp. The people will get his butt to work cutting down trees cleaning up trash all to be supervised by taxpayers with whips and trained German Shepherds

While this is an old article, and Bond vs. US has been ‘settled’ in Bond’s favor back in June, our cowardly Supreme Court did not strike down Holder’s main argument. They deftly avoided the issue of limits of treaties by simply ruling that Bond’s actions did not violate the treaty.
More people need to know the 5 elements of good laws:
1. Generality - Laws shouldnt be specially carved out to benefit one group or to attack or harm a narrow group of individuals.
2. Prospectivity - This is the constraint on ex post facto laws. Laws should always apply in the future and never to the past.
3. Publicity - Laws should be broadly published and well known, both to the representatives themselves and general public.
4. Consent - Laws must be generally acceptable to those who will live by them.
5. Proper due process - Due process means that the law is meted out equally and fairly with each similar crime being treated the same. Justice must be blind.

so maybe this is a windup for a pitch to the USSC that will occur in a window that is between the next retirement and replacement, and the next presidential election?
i guess not if he is arguing this in front of the ussc now— maybe he feels like it is lucky day (and/or they have something on roberts)
International Law is a fiction. It’s only a collection of agreements between nation states.

this should be the first priority of the new Congress: impeach and remove Holder as he is unfit to serve the Constitution he swore to uphold.
