Not a Chokehold:The Truth of the Garner Arrest

...And it was a headlock, not a chokehold. To be a chokehold, there must be constant pressure on the person’s neck, compressing his windpipe or cutting off the flow of blood to the carotid artery, rendering him unconscious.

Watch the video: It’s obvious that the arresting officer put his arm around Garner’s neck to bring him to the ground — but once Garner was on the ground, he was still conscious and able to say he couldn’t breathe.

That’s when the officers called for medical back-up. Tragically, the EMS personnel failed to administer oxygen or to ascertain that Garner was asthmatic and use an inhaler to assist with his breathing.

A top medical examiner (who can’t publicly fault the city ME) tells me it was very irresponsible for the Medical Examiner’s Office to issue the press release stating that Garner’s death was caused by a chokehold (with asthma, heart disease and obesity as contributing factors) and ruling his death a homicide.

Yes, that is probably what happened.

However, what about the right of the merchant who called police to be able to sell his products legally without having this man parasite his customers?

Are the police just supposed to let the man stand out in front of the store and break the law at the expense of those who do not break the law?

Is that what you are suggesting?

To be honest with you, I do not care at all about smears or smear attempts.

I care about truth and facts. I am not concerned with how the lunatics and liars of this world behave, because they are beyond reason and rationality.

Yep he deserved summary execution for that crime. I bet the kgb reports of the 1 970 sounded a lot like the language you use.

Because it clearly was not a choke hold, and the man was not killed by a choke hold.

I trust the video, it wasn’t a choke hold, it was plain strangulation — had nothing to do with holding. The man wasn’t going anywhere. He was just being passive aggressive, like a protester at a big protest sit in.

I am aware that he died as a result of what he inititaited (sic) that day, but there is no proof at all of what killed him specifically, and there is no proof that anyone intended to kill him....

Please just stop. You don't convince me - you don't convince others here. Wrongful death doesn't require "intent" if I recall correctly. Action - Results, rightly or wrongly. I never said the particular officer should be held criminally liable. I only said the man is dead because of bullshit taxes on a legal product which he was trying to sell. If you insist to try and make this a major criminal case, you're barking up the wrong tree in my book.

It’s not that he wanted to kill him or not (he didn’t). It’s the Cops attitude — anybody that does that like that is psychologically unfit to be a police officer.

He wanted the man to move, he could have done it just as well with a thumb lock.

Yeah, we covered that already. What’s your issue with what I said? I certainly did not deny truth or facts in my previous post. I did say, and still maintain that the skin color of the sergeant on scene is totally irrelevant. You’re not countering that assertion.

That does not mean he hadn't been choked. It just indicates the cop had stopped choking him. Evidence from the med examiner in consistent with choking. "10 hemorrhages on the inside of the neck, in the muscles of the neck, petechial hemorrhages in the eye, hemorrhage in the tongue. And those are all evidence of neck compression"

Another way of putting it was that his health was so poor that it could not sustain him through resistance. Saying he was killed isn’t true in a direct way, only in a very indirect way. Garner does not appear to have died from injury, but from exertion, asthma, and being fat. ...and the police were attempting to stop the exertion, not propel it.

Happens all the time in diving. If you over breath what your air supply can deliver it feels like you can’t breath. It can cause panic and can escalate into all kinds of deadly problems. It’s a physiological response from the body which takes a lot of training to overcome.

Here’s the problem....he’s moving around...causing the hold to change. Stop blaming the cop for doing his job. This piece of crud has had 30 arrests. All he had to do was from the onset...was stop....instead of flailing at the cops...

Please indicate to me at which second mark a knee to the back or chest of Garner is visible and how long that knee to the back or chest of Garner remianed inhis back or chest.

If you or I commit an action which contributes to a person’s death it can be called manslaughter. If the action we take is illegal it is much more likely to be deemed manslaughter.
