Another way of putting it was that his health was so poor that it could not sustain him through resistance. Saying he was killed isn’t true in a direct way, only in a very indirect way. Garner does not appear to have died from injury, but from exertion, asthma, and being fat. ...and the police were attempting to stop the exertion, not propel it.

If you or I commit an action which contributes to a person’s death it can be called manslaughter. If the action we take is illegal it is much more likely to be deemed manslaughter.

That's a very interesting point. If it can be shown that Garner died from exertion, and not from anything the cops did, then the cops are without fault. It would be sort of like collapsing while running away from a police officer.

But based on the video, I don't think that's the case. As I posted previously, I think that's something an open jury should decide.
