...And it was a headlock, not a chokehold. To be a chokehold, there must be constant pressure on the persons neck, compressing his windpipe or cutting off the flow of blood to the carotid artery, rendering him unconscious.
Watch the video: Its obvious that the arresting officer put his arm around Garners neck to bring him to the ground but once Garner was on the ground, he was still conscious and able to say he couldnt breathe.
Thats when the officers called for medical back-up. Tragically, the EMS personnel failed to administer oxygen or to ascertain that Garner was asthmatic and use an inhaler to assist with his breathing.
A top medical examiner (who cant publicly fault the city ME) tells me it was very irresponsible for the Medical Examiners Office to issue the press release stating that Garners death was caused by a chokehold (with asthma, heart disease and obesity as contributing factors) and ruling his death a homicide.

“Despite the media spin, this has nothing to do with race.”
I agree with respect to the actions of the police. I disagree with respect to the actions of the msm (as you have pointed out), holder, obama, and many in the general public.
With the msm, holder, and obama, many in the general public, this is all about race. And as such, it is important to make it clear to as many people as possible, that with respect to the actions of the police, it was not about race; and therefore it is important to hear what the black Sargent has to say.
I would also add that Wilhelm's agenda as well as Obama's and Holder's agenda is to nationalize the local police. That's why the media is pushing the meme that the local police are out of control.
I find it amazing that a few conservatives (not a lot) fall for this Wilhelm-Obama-Holder Big-Centralized-Government agenda.
Hands up, don't shoot.
I feel that time spent countering the fallacious arguments of the left, using their own criteria, is time truly wasted.
That’s a great question. Given that he was morbidly obese, was diabetic, was a smoker, and was asthmatic he was probably exactly one stressful event away from a coronary. What was that stressful event? Not getting arrested, because he had been arrested more than 30 times before. It was his voluntary decision to resist arrest that caused his final adrenaline rush. He thought he was a tough guy. Oops
Ya I can somewhat agree. I hate the msm.
I am doing this from my iFunny and it is too difficult to enter the HTML and properly bold the sections that directly apply to the msm
The MSM is generally evil and wicked, they fit this description:
Romans 1:..
28 And even as they did not like to retain God in their knowledge, God gave them over to a reprobate mind, to do those things which are not convenient; 29 Being filled with all unrighteousness, fornication, wickedness, covetousness, maliciousness; full of envy, murder, debate, deceit, malignity; whisperers, 30 Backbiters, haters of God, despiteful, proud, boasters, inventors of evil things, disobedient to parents, 31 Without understanding, covenantbreakers, without natural affection, implacable, unmerciful: 32 Who knowing the judgment of God, that they which commit such things are worthy of death, not only do the same, but have pleasure in them that do them.
Proverbs 6:16-19
haughty eyes, a lying tongue, hands that shed innocent blood, a heart that devises wicked schemes, feet that are quick to rush into evil, a false witness who pours out lies and a person who stirs up conflict in the community.
Except that it was not unlawful and there is no evidence that any specific action taken by police actually caused the man to die.
The grand jury considering manslaughter charges as I understand.
I do not believe that it can be proved that the 4 people sitting on him and the guy twisting is head caused death.
Maybe they did, maybe they didn’t.
Maybe he had a heart attack and died right then and there.
Sure they want the thugs controlled. Controlled not killed.
Simply that he should have the right to bring up for discussion whatever aspect he wants to discuss.
To me, it doesn’t matter if the sergeant was black or white or anything else. I would still like to her the sergeant’s thoughts, and I am curious as to why I have not.
If the gentlemen thinks that the sergeant’s being black is a point of importance, I am willing to at least hear why he thinks that, but I do not believe that is an important factor.
11 Facts About the Eric Garner Case the Media Wont Tell You
Sources in the mainstream media expressed outrage after a grand jury declined to indict a New York City policeman in the death of Eric Garner, but there are 11 significant facts that many of them have chosen to overlook:
1. There is no doubt that Garner was resisting an arrest for illegally selling untaxed cigarettes. Former New York City Police Commissioner Bernard Kerik put it succinctly: You cannot resist arrest. If Eric Garner did not resist arrest, the outcome of this case would have been very different, he told Newsmax. He wouldnt be dead today.
Regardless of what the arrest was for, the officers dont have the ability to say, Well, this is a minor arrest, so were just going to ignore you.
2. The video of the July 17 incident clearly shows Garner, an African-American, swatting away the arms of a white officer seeking to take him into custody, telling him: Dont touch me!
3. Garner, 43, had history of more than 30 arrests dating back to 1980, on charges including assault and grand larceny.
4. At the time of his death, Garner was out on bail after being charged with illegally selling cigarettes, driving without a license, marijuana possession and false impersonation.
5. The chokehold that Patrolman Daniel Pantaleo put on Garner was reported to have contributed to his death. But Garner, who was 6-foot-3 and weighed 350 pounds, suffered from a number of health problems, including heart disease, severe asthma, diabetes, obesity, and sleep apnea. Pantaleos attorney and police union officials argued that Garners poor health was the main cause of his death.
6. Garner did not die at the scene of the confrontation. He suffered cardiac arrest in the ambulance taking him to the hospital and was pronounced dead about an hour later.
7. Much has been made of the fact that the use of chokeholds by police is prohibited in New York City. But officers reportedly still use them. Between 2009 and mid-2014, the Civilian Complaint Review Board received 1,128 chokehold allegations.
Patrick Lynch, president of the New York City Patrolmens Benevolent Association, said: It was clear that the officers intention was to do nothing more than take Mr. Garner into custody as instructed, and that he used the takedown technique that he learned in the academy when Mr. Garner refused.
8. The grand jury began hearing the case on Sept. 29 and did not reach a decision until Wednesday, so there is much testimony that was presented that has not been made public.
9. The 23-member grand jury included nine non-white jurors.
10. In order to find Officer Pantaleo criminally negligent, the grand jury would have had to determine that he knew there was a substantial risk that Garner would have died due to the takedown.
11. Less than a month after Garners death, Ramsey Orta, who shot the much-viewed videotape of the encounter, was indicted on weapons charges. Police alleged that Orta had slipped a .25-caliber handgun into a teenage accomplices waistband outside a New York hotel.
I certainly do agree with that.
I do not think that this incident involved the issue of race in any way, so I can see why discussing the race of the sergeant isn’t particularly useful.
But still, if someone does wish to discuss it, I would discuss it provided their points have some sort of merit.
I would also agree that saying that the state is absolved because there was a black sergeant there is not a valid point.
Yes.
I thought are that his actions and choices contributed to his death directly.
He is clearly responsible for what happened to him on that day, and he is also responsible for the condition of his own body.
I feel bad for the man, but I am not willing to throw someone in jail or even on trial for choices that eric garner made.
The police tried to take Garner into custody and he resisted. The police then used a standard takedown technique that they were trained to use.
Garner's physical problems apparently couldn't withstand his own actions of resistance and the police's standard takedown actions.
Agree on police not needing to take a medical history before an arrest. It just appeared to the couple LEOs I spoke with that NYPD officers being on Garner could be a contributing factor to positional asphyxia.
It appears to me that Garner is in some sort of distress after the arrest. What did the NYPD do to render assistance in addition to callng for EMTs?
Did the autopsy mention anything about a forced prone position? I will check.
Again, we’re in agreement. My comments that this particular aspect of the topic is wasteful and will be negatively portrayed does not in any manner impinge upon his right to discuss it. That’s why it was posted as an opinion. Differing opinions used to be met with debate of their respective merits, instead of accusations of censure. Alas FR.
>Except that it was not unlawful and there is no evidence that any specific action taken by police actually caused the man to die.-—
I’ll do ya one better. The video shows him to be so agitated that in his condition he may have dropped dead on his own. The tactics chosen by the officer added a ton of fuel to that fire though.
>The grand jury considering manslaughter charges as I understand.—
My understanding as well. However we do not know what evidence was allowed in. Speculation is the prosecutor did not want a true bill, so evidence to support manslaughter may have not been admitted.
Did he break the law or not? Yes, he was breaking the law. Did he resist arrest? Yes he did. If he had not broken the law in the first place and not resisted arrest, he’d still be alive. How hard is that to understand?
He has previous arrest of resisting....plus about 30 other arrests.
