Reuters) - The secret marriage this year of a 96-year-old Virginia woman and a 95-year-old man has drawn the scrutiny of a judge, who has ruled the marriage may be illegal, a lawyer said on Tuesday.
Judge James Clark of the Alexandria Circuit Court ruled this month that the marriage between Eddie Harrison and Edith Hill may not be legally binding and ordered Hill's attorney, Jessica Niesen, to investigate it.
The legality of the marriage surfaced during a custodial dispute over who should care for Hill, who was ruled legally incapacitated in 2011.
Hill's granddaughter, Rebecca Wright, and daughter Patricia Barber have been the woman's legal custodians since early this year, Barber's attorney, Cary Cucinello, said.
As part of the custodial dispute, family members have challenged the marriage in court after they discovered the two had wed this year without telling them.

A friend of mine is a lawyer. He deals with this all the time. Many times, the couple must marry in secret to keep the kids from suing.
My grandfather remarried at age 67. Lived married another 22 years. Made my step grandma’s family very angry.
Grandpa took all of her money, and put it in escrow. When she died, he gave it to them. Still made them angry.
When we started the fight it was so we could get Dad out of the home. He really wasn’t far enough along to belong there. Besides he had enough income and money that he could have stayed in his home (which is what he told us he wanted to do) and hired care. As the case progressed we found out that she had stolen the money. Regardless of who was the trustee hubby was still supposed to get half so that wasn’t the purpose for the suit.
That sounds reasoned.
I’m a firm believer in family members staying in their homes as long as they can.
I think folks need to consider how they can manage that for themselves too, long before it’s needed.
The costs are a lot less if you manage it properly.
“Theres money involved somewhere, thus the dispute (Admittedly, I did not click the link to read more)”
You should have read the whole article.
Yeah because that’s the biggest problem we have.
OK, I went back and read the whole thing, confirming what I assumed. $475,000 at stake here...... It’s about the money.
Paragraph 3 ...

FWIW the full article is nine paragraphs.
If they just tell the judge they’re gay or transgender (or polygamous), the paperwork will go through with no question at all.

I guess if it was your infirm mother, you would rather a 96 year old stranger decide what is best for her rather than you.

If they need homecare nursing the cost is prohibitive for all but the filthy rich.
My Mom held out as long as she could living at home, but the nursing was about $100,000 a year!
She is in an upscale nursing home now that is quite nice, but even that is over $30,000 a year.

It is surprising that this sweet old couple have been close for over 10 years and yet neither family appears to have become friendly enough to prepare for future care, finances and living arrangements.
I found the interracial and age aspects endearing. Wonder why their children didn’t see this coming????
So being treated like a child in your late years is dignified?
These people have been through it all.
Leave em alone...
You assume a lot.
Why is it illegal? Because they aren’t gay?
if that were grounds, half the marriages in the country would be invalid!!!
If you buy a long term care policy in your 40s, the fees are rather low. They don’t go up all that much over time.
People wait and then they find out they need that kind of a policy. Then it’s cost prohibitive and too late.
The payouts on these can last for years. They’re well worth it because 75% of the public will need this sort of thing.
Yes, it’s very expensive these days, if you pay out of pocket.
rofl
it never fails to amaze me just how stupid humanity can really be!
You have that right.
