Not perfectly sound. The sponsors of the initiative have standing; to say otherwise is ludicrous (is that a legal opinion?).
This happened in California before. The state officials refuse to support the will of the people as expressed at the ballot box.
We passed prop 187 to restrict benefits for illegal aliens.
Gay Davis refused to defend it in court. That is the biggest contribution to the mess we have been in in Cal even before OB, the hero of benghazi came along.
We have the right to honest, legal elections. If that right was violated because an ineligible or fraudulant candidate is elected, citizens have standing, by virtue of their rights, to bring a case/
“Standing” being so tightly interpreted, merely makes it easier to go against the results of elections. I voted in those elections and I claim standing.
As long as we bring in millions of immigrants, legal and illegal, the left will grow, not decrease in numbers. We will add 130 million to our population in the next 40 years--80% will be driven by immigration. And 87% of the 1.2 million legal immigrants who enter annually are minorities as defined by the USG, And those numbers don't include the impact of an amnesty that will add 33 million legal immigrants over the next 10 years.

But hey - “it doesn’t matter”. Yes, yes, it does. Now, we’ll see plenty of folks get married in one state and deliberately move to another one and sue to get recognition.
We’ll see O push for a ‘gay marriage law’, forcing all the states to recognize gay marriage. And the courts will say it’s ok. ;)
DOMA was precisely that - an attempt to protect marriage. Now that it’s gone, we’ll see the Imperial state try to ram it down our throats.

Don't believe everything you read on the internet. Especially when references are not given.
Minnesota, for example, does NOT explicitly require consummation. I imagine quite few other states are like them. What they do allow is the annulment of a marriage which is not consummated and where there was fraud on the part of the partner at the time of the marriage who hid the fact that they were incapable of consummating the marriage.
Ironically, your list of 13 supposed states requiring consummation include 4 states which allow same sex marriage: Connecticut, Delaware, Minnesota, and Vermont.
That’s between the citizens of California and their elected leaders and judges, the Fed has nothing to do with it. SO when do the impeachment hearings on the California justices begin? How many of the elected leaders who refused to initiate these impeachments were thrown out of office in the last elections? Never and very few, you say. Sounds like a problem with the California voters, not the USSC.

The CA governor who didn’t defend prop 187 was recalled. Unfortunately, probably not for that reason.

They are going to push for federal recognition of gay marriage as legal.
They HATE states rights, but they can’t get to this without getting rid of DOMA. DOMA is the first step. Dump DOMA then now they will set up some case against a particular state and then O will try to ram through a bill forcing all states through the same ‘full faith and credit clause’ to recognize gay marriage.
Am I blind? Am I the only one who sees precisely what Obama is going to do?
That’s where the Immigration bill comes in, every ponzi scheme needs a new layer of suckers.
Ah just admit it, no state court will uphold any measure like prop 8 and here come the lawsuits. Gay marriage will be forced in all states eventually.
1) A gay marriage law is not going to pass the House.
2) Your real issue is going to be when Tadd and Todd move from New York to Georgia and claim the right to be "married" due to the Full Faith and Credit clause of the Constitution in the absence of DOMA. If gay marriage is forced down our throats, it will be by judicial fiat.
3) It will be interesting to see what the court does when Obama tries his stunt. I'd submit you could get away with it with a NY applicant, but not one in TN.

I don’t care who does what. I don’t have to agree with it. I damn sure don’t have to “celebrate it”. I don’t have to subsidize it (CommieCare mandating I pay for others contraception). I have freedom of association, I don’t have to associate with homos or have the state force their agenda onto my children.
Marriage is one man one woman. That has always been the meaning of the word.
