She refused to answer questions. Yet she badly miscalculated. She began with a self-righteous opening statement claiming she did nothing wrong. Only after defending herself did she invoke her Fifth Amendment rights. At what point can she be slapped with a charge of Contempt of Congress?

Issa just made the statement that she may have waived her right to use the 5th Amendment against self-incrimination by presenting facts in an opening statement. Apparently they’ve been doing some legal work on this and it appears they are of the opinion that she will be compelled to testify now. WOW!!!

"Republicans on the committee thought they had been defeated, but Gowdy knew better. Once a person issues a statement, Fifth Amendment privilege is waived on the substance of the statement. By issuing an opening statement, Ms. Lerner was testifying. Her right to stay silent on that testimony was gone forever.
A panicked liberal Elijah Cummings of Maryland pointed out that while congressional hearings are like a court of law, they are not in actuality a court of law. Even Congressman Issa, normally a very sharp and prepared operator, had to check on whether Gowdys interpretation applied.
It absolutely does."

And this ladies and gentlemen is why you actually make them appear and assert their 5th amendment right in person instead of just telling them they don’t have to come after receiving a letter from their lawyer saying that they intend to invoke that right if compelled to appear.

Tomorrow should be an interesting day of ‘testimony’ from Ms. Lerner. She might get a better lawyer who won't stab her in the back from the git go. I wonder if Ms. Lerner thinks she has been set up to take the big fall for the Obama Scandals fiasco?
Ms. Lerner had the opportunity to testify or not testify, but she does not have the right to kinda sorta testify on what she chooses and then dummy up on other subjects.
