Top IRS official will invoke Fifth Amendment

WASHINGTON – A top IRS official in the division that reviews nonprofit groups will invoke the Fifth Amendment and refuse to answer questions before a House committee investigating the agency’s improper screening of conservative nonprofit groups.

Lois Lerner, the head of the exempt organizations division of the IRS, won’t answer questions about what she knew about the improper screening – or why she didn’t reveal it to Congress, according to a letter from her defense lawyer, William W. Taylor 3rd.

Lerner was scheduled to appear before the House Oversight committee Wednesday.

“She has not committed any crime or made any misrepresentation but under the circumstances she has no choice but to take this course,” said a letter by Taylor to committee Chairman Darrell E. Issa, R-Calif. The letter, sent Monday, was obtained Tuesday by the Los Angeles Times.

Interesting thing about criminal conspiracies is that the first one to get to the prosecutors is generally entitled to immunity. With this news I suspect a lot of lawyers are racing to courts or prosecutors looking to make deals for their clients.
This is all going to unravel in the end of the month. Wouldn’t surprise me if this woman’s attorney is already talking to Issa’s staff attorney.

Lois Loser will land on her feet and be appointed as the new ambassador to THE DUCHY of Grand Fenwick, not "Grand Fenwick" as I carelessly posted.

Actually, I knew the correct appellation.....having been born and raised in the Principality of Pretzelstein which borders Fenwick to the north.

Sure. But that’s all useless until the local republicans start believing principles matter to begin with. Then, when faced with the ‘lesser evils are good’ crowd, tell them to piss off. Otherwise we may as well just keep the same thing in office now and accept moderation.

She can plea the 5th BUT there is no way she should be able to continue her job as head of IRS Obama Care.

Lerner is not head of IRS Obama Care. That would be Sarah Hall Ingram, who also needs to be subpoenaed.

Interesting the WH and Treasury were working together on exactly how to reveal this scandal to the public-a month before Lerner’s phony planted question, which Miller claims was his idea.

Well, there’s no doubt that there was a very large criminal conspiracy ongoing from high places in our government. The only question is how high? Was definitely higher than this lady. And seeing as how the criminal conspiracy crossed over to several federal departments and agencies, the orders had to be coming from the very top. No one had to “inform” the president. He’s not senile. He did not forget who ordered these attacks on the press and his political enemies.

Pleading the 5th on your tax returns is deemed to be a frivolous claim and immediately makes you eligible for fines.

Exactly, and what is good for the goose is good for the gander. Fine her ass off every single time she pleads the fifth amendment. And constantly remind that her testimony is "voluntary." Go up the IRS chain of command and repeat.

The only way a special prosecutor can compel testimony is to grant immunity.

3) Boehner has power to appoint special prosecutor.

The Speaker of the House is a Legislative official and does not have power to prosecute or to appoint a special prosecutor.

5) Boehner fails to act.

I suppose Boehner also failed to prevent the tornado in Oklahoma. /s

It makes me absolutely crazy that people who were all for lesser evils to ‘win’, are suddenly upset when the chickens come home to roost. We collectively put gutless unprincipled cowards into power on the belief they were superior to the Dems and winning was everything. Now, when the SHTF, we expect them to act on principle and are shocked when they act like gutless unprincipled cowards..

Talk about a F’ing disconnect.
