The only way a special prosecutor can compel testimony is to grant immunity.

3) Boehner has power to appoint special prosecutor.

The Speaker of the House is a Legislative official and does not have power to prosecute or to appoint a special prosecutor.

5) Boehner fails to act.

I suppose Boehner also failed to prevent the tornado in Oklahoma. /s
