Top IRS official will invoke Fifth Amendment

WASHINGTON – A top IRS official in the division that reviews nonprofit groups will invoke the Fifth Amendment and refuse to answer questions before a House committee investigating the agency’s improper screening of conservative nonprofit groups.

Lois Lerner, the head of the exempt organizations division of the IRS, won’t answer questions about what she knew about the improper screening – or why she didn’t reveal it to Congress, according to a letter from her defense lawyer, William W. Taylor 3rd.

Lerner was scheduled to appear before the House Oversight committee Wednesday.

“She has not committed any crime or made any misrepresentation but under the circumstances she has no choice but to take this course,” said a letter by Taylor to committee Chairman Darrell E. Issa, R-Calif. The letter, sent Monday, was obtained Tuesday by the Los Angeles Times.

legally, silence in America does not imply guilt. As a general rule, when you're having a really bad day it's better to say nothing.

I think the rest of the world does it exactly opposite of the way we do, but once you've pled the 5th you have other troubles ~ like keeping your job.

A reality show. The scapegoats’ prison. It’s some ankle bracelet country club somewhere in Kenya or Camp David (BO never uses it).

I believe Boehner has been stonewalling Issa on several investigations.

Now that at least one official is pleading the Fifth, it's going to be difficult for Boehner to sweep this under the rug like Fast n' Furious. Really difficult. Though I'm sure he'll try....

Weren't we discussing someone who may be accused of a crime? You cannot infer guilt from their response. Witnesses are different ~ you slipped into a discussion of witnesses. We want the guys at the bottom to become witnesses because we know the real criminals are at the top.

I hope somebody remembers to tell the witnesses that by fully testifying in the open about the misdeeds of others they will win their cases at the MSPB. That will pay their legal fees, so lawyer up!

This better not be a “courtesy 5th” where she doesn’t even have to show up. Subpoena her, make her appear, make her say the words out loud on live TV - “On advice of counsel I respectfully decline to answer on the grounds that it may tend to incriminate me”. MAKE HER SAY IT!
