The difference is that between breaking the law as a citizen and taking up arms against your country, which you do at the disregard of your citizenry.
He should be seen as an enemy combatant with a group of people we are at war with (Islamofascist terrorists) and, rather than being read his rights and arrested, we should be waterboarding him trying to find out who else is in his cell and what their next actions are against this country.
If there is an extended cell and they commit another attack on this country, the blood of those victims will be directly on those who decided to follow the route of arresting him as a criminal.
Common misconception there. No one, cops or otherwise, has to read a hoodlum his rights. They just can’t use anything he says before that reading against him. In the case of this dirtbag the evidence pile is a mile high and he’d be tried/convicted whether he mumbles anything or not. As for the one that was a U.S. citizen, the case hinged on war powers of the POTUS. We aren’t in a declared war and the current POTUS has declared publicly that the war on terror is over. We have specifically stated that we are not at war with Islam and we clearly are not currently at war with Russia.
Like many SCOTUS decisions, this one is heavily flawed. It draws no distinction between citizens and noncitizens. How does a citizen prove that they are not a foreign combatant, if they are not afforded Constitutional rights? Indeed, why are they having to prove their innocence in order to get a customary trial?
Providing the POTUS the ability to declare citizens to be less than citizens defeats the entire purpose of the Constitution. Constitutional protections are intended to keep us safe, no matter who is elected.

Ah, but we are. The Resolution for The Use of Military Force IS a "declaration of war".
And there are specified formal measures that have to be taken in order to end a war -- starting with a formal process declaring the "end of hostilities" and requiring Congressional assent. Bush took this step in Iraq.
Obama may have said the War on Terror was over...but he has never formally ended it. In Afghanistan or anywhere else. We remain in a state of war with the forces of Islamic Terror.

When he was discovered by the man who owned the boat, they sent in one of their helicopters to determine if they could detect a heat imprint in the boat. They did and they then knew whoever was bleeding out in the boat was still alive.

SCOTUS decisions are not replacements for the Constitution. Either you have rights or you don’t have rights. If you only have rights at the discretion of the POTUS, then you have no rights.
Given their stated desire that all terrorists be white, right-wing extremists, its damned scary.

I should have been more specific with my question.
Why didn’t they use a drone during the day instead of having the entire police force out there? Couldn’t a drone detect a body in a shed or boat? Couldn’t a drone have flown further than the area the police was focused on?
When the civilian saw the blood,it became a no brainer at that point. There was no longer a need for bloodhounds.
