Missouri House Proposes Jail Time for Feds Violating the 2nd Amendment (Don't tread on Missouri)

Missouri conservatives proposed a bill that will punish feds violating the Second Amendment with jail time. The Tenth Amendment Center reported:

Introduced by Missouri State Representative Casey Guernsey, with 61 co-sponsors, is the Missouri 2nd Amendment Preservation Act. House Bill 170 (HB170) would nullify any and all federal acts, orders, laws, statutes, rules, or regulations of the federal government on personal firearms, firearm accessories, and ammunition.

The bill states, in part:

“Any official, agent, or employee of the federal government who enforces or attempts to enforce any act, order, law, statute, rule, or regulation of the federal government upon a personal firearm, a firearm accessory, or ammunition that is owned or manufactured commercially or privately in the state of Missouri and that remains exclusively within the borders of the state of Missouri shall be guilty of a class D felony.”

A class D felony in Missouri carries a prison sentence of up to 4 years.

While a number of states, including Wyoming, South Carolina, Indiana, and others – are looking to go head to head with the feds on specific issues under the 2nd amendment, the Missouri legislation is the strongest introduced anywhere in the country so far.

A bill filed in Texas puts any fed who comes in our state to take weapons, in prison for 5 years. Attorney General Abbott says he will have them arrested right then if they come into Texas with that intention.

I think Hussein/Holder should forget about Texas.

It shall be unlawful for any officer or employee of this state, or any political subdivision, or any federal firearms dealer licensed under 19 U.S.C. Section 923 to enforce or attempt to enforce any act, law, statute, rule, or regulation of the federal government relating to a personal firearm, firearm accessory, or ammunition that is owned or manufactured commercially or privately in the state of Missouri and that remains exclusively within the boundaries of the state of Missouri.

Wouldn't that include any laws federal against owning fully automatic weapons and sawed off shotguns?

Rep Todd Akin on May 26th 2012 concerning the 17th Amendment......

Calling himself a “strong conservative,” Akin said he has “a very serious concern about erosion of states’ rights and reversing this decision might pull that balance back.”

Akin’s two main rivals in the GOP race — John Brunner and Sarah Steelman — said that while they agreed too much power has migrated to the federal government, they were in favor of keeping the 17th Amendment in place.

Supporters say the amendment reduces corruption by reducing the influence of state legislators and gives more power to the public. Opponents say allowing legislatures to pick senators would make them more accountable to their states and reduce the number of unfunded mandates handed down by Congress.

Currently the Feds can take weapons away from illegal aliens and prosecute them for unlawful possession. Will they still be able to do that is this bill passes in MO?

I’m a retiree, too. Come to Springfield; I like it here. We’re mostly conservative, but we’ll need more in numbers. MO. has a Dem governor, tho. But for pete’s sake, anywhere should be better than NJ.! (I don’t mean to insult your state, in case you like it, but.........)

Are you kidding? Where do the Feds prosecute them for anything??

We have County Sheriffs who can do that better, and who won’t take weapons away from anybody else.

With places like Texas and Oklahoma, Wyoming following suit, this looks good.Hmmm Here in Texas we are allowed to stop illegal burglars with the use of deadly force as well, so when the state passes law that makes it a felony for a fed to search your home for firearms...Just say’in..

Because in the 30’s, the winds connected to the Dust Bowl were damaging farms in Missouri.

Today, no one is willing moving to California except the illegals from south of the border.

Now, lets see if: a) it passes and b) if they can override the inevitable veto!

The republicans have the votes to override anything Nixon vetoes. Whether it happens or not is another story.
