The suspect in a shooting that left a U.S. congresswoman wounded pleaded guilty Tuesday to going on the rampage that killed six other people. The plea spares Jared Lee Loughner the death penalty in an attack that gained worldwide attention.
The plea came soon after a federal judge had found that months of forcibly medicating Loughner to treat his schizophrenia had made the 23-year-old college dropout competent to understand the gravity of the charges against him and assist in his defense.
At one point, Judge Larry A. Burns asked Loughner if he understood the charges against him and what the government would need to convict him.
"Yes, I understand," Loughner replied.

Pima County's top prosecutor said last year that she may file state charges in the case that could carry the death penalty. In an agreement with federal prosecutors, County Attorney Barbara LaWall agreed that the federal prosecution would take place before she could bring charges.
LaWall has been unavailable in recent days, and officials in her office have repeatedly declined to comment, saying the office did not have an active prosecution against Loughner.
A state prosecution after a successful federal one would not be unprecedented. Oklahoma City bombing conspirator Terry Nichols avoided the death penalty on federal charges after a 1997 trial and was given a life sentence. State prosecutors then tried him again, but a state jury also declined to sentence him to death. Well that doesn’t look like the plan for the Feds based on the agreement....but I guess we will see what the state does next.
I think Newt has it right on this. Justice is lacking in this country....particularly when dealing with these type people.

The Colorado shooter was identified correctly as a real threat...the problem is what to do with the info.

Once these guys realize they're not getting out, they are more likely to open up and discuss what's going on in their brains.
A well trained psychiatrist can gain valuable insight into behaviors that may help profile potential multi-victim shooters. ]

While it is my opinion that Loughner deserves to be put to death for his actions, I do agree to this outcome if all relevant victims agree since it releases them from years of legal conflict. However, I do have concerns about one legal point- the fact that the act committed was in violation of federal laws, which this trial was all about, and also in violation of State laws, which Loughner can possibly be tried for, seemingly placing him in jeopardy twice for his crime in direct contradiction of amendment V of the US Constitution. Can anyone explain to me why this is not so?
We don’t follow the Constitution in this country.
All the news is about wounding this Gabby Giffords, and mentions in passing he KILLED 6 other unnamed people.
One was the Federal Judge down there. But Gabby was/is a D and that is all that matters to media.
I’m still waiting on the left to issue a heartfelt apology for despicably trying to link the shooting to Sarah Palin, talk radio, the Tea Party, and conservatives in general. I won’t hold my breath, however.
This plea agreement resolves the federal charges, such as murder and attempted murder of federal employees, that the state cannot bring. There remain viable state charges that have not been brought, such as murder of the 9 year old. The Constitution says that you can’t be tried twice for the same crime. It doesn’t say that you can’t be tried twice concerning the same “event.”. This creep, like the one in Aurora, CO - racked up multiple crimes for the same event - a mass shooting - and he could be tried for them all.
For now until the November elections.
The guy killed 6 people, they feed him tranquilisers for 6 months and then decide to let him live.
He needs to be executed and soon.
The death penalty is not a deterrent because we so seldom use it and wait 20 years to do it.
California has 600 on death row who will die a natural death long before they are executed.No wonder it isn’t a deterrent.

That’s kind of what I meant when I said Justice is lacking in this country. If it were implemented swiftly particularly in clear cut cases such as this I believe it would be a good deterent.....as it is they just offer you free room and board and celebrity status for the rest of your life on the tax payers dime.
