. . . I get the strong sense from a few anecdotal stories about Roberts over the past few months and the way he has written this opinion that he very, very much was concerned about keeping the Supreme Court above the partisan fray and damaging the reputation of the Court long term. . . .
Second, in writing his case, Roberts forces everyone to deal with the issue as a political, not a legal issue. . . Third, while Roberts has expanded the taxation power, which I dont really think is a massive expansion from what it was, Roberts has curtailed the commerce clause as an avenue for Congressional overreach.

Robert’s an idiot. He says Congress can tax nothing.
The new tax will now be known as the “Roberts Tax.”
In my opinion, this paves the way and lays the ground work that will allow the government to mandate that every citizen must possess on their person - at all times - an identification, such as a mark, in order to conduct any type of transaction, health care, economic, or otherwise.
Not his job. He's not a schoolyard monitor. If his conscience can allow him to sleep at night without chemical aids, he's a psychopath.
The John Roberts' court just ended Freedom and Liberty. We will be Nazi Germany in six months !
Screw reputation, what about looking at the Constitution and looking out for the People's rights?
I don’t think one guy’s opinion of Roberts is breaking news.
Can the G. make me buy stuff?
Clearly the “voice of reason” thinks they can. He is sub-human filth.
While Roberts is right, he DID decide on government tyranny which is AGAINST the Constitution.
Dread Pirate Roberts.
roberts is simply this century’s Roger B. Taney, offering the most idiotic of notions folded into carefully crafted rhetoric.
What comes next is on his shoulders.
I’m not down on him either. He has vindicated Joe Wilson and publicly called Bambi a liar - as has the liberals on the court.
Remember - all along Bambi proclaimed this was not a tax, even while his administration told the court it was a tax - the court ruled it is a tax - ergo, Bambi is a liar.
How does this keep it above the partisan fray, when the majority of the people hate it?
Based on his past 2 descisions, Roberts is a liberal. Wouldn’t be surprised if he constantly voted with the other libs from now on. Thanks W. Greet job in vetting this clown.
One good thing in this is that Americans won’t be feeling sorry for Obama in November.
You’re wrong. It is a massive expansion of government power. Regardless of whether Obamacare is repealed this is judicial precedent giving the feds the power to mandate anything they want. Roberts is a tool.
Ignorant statement. What kind of tax is it? You're being taxed for not buying something, so it can't be a sales tax. It is independent of income, so it is not an income tax. It is not levied on a commodity being purchased, so it is not an excise tax. You can avoid it by buying an insurance policy, so it is not a head tax.
What kind of "tax" is this? A previously unknown form? The answer of course is that it is not a tax at all. It is a financial penalty for unapproved but legal behavior. Calling it a tax does not make it one. Roberts has sold out, for what mess of pottage god only knows
The ruling says it is not his job to decide whether the laws we pass are good for us or not.
In other words, if this law is good or bad is not up to him- he just decides if it was constitutionally passed or not
So...
We the people get whatever we vote for- in this case they crammed it down our throats, but we voted these turds into office
Now we have to vote others in who will repeal this.
Being a “glass is half full” kinda guy, I am going to say THIS GIVES US OUR MAIN ISSUE for 2012
No GOP has to spend money on anything else other than to say YES I will repeal it
We could win in a landslide because of this.
Obamacare should be a political decision, not legal. Therefore I concur with CJ Roberts on this. Congress has the power to tax anything and everything in any amount they can get passed.
This should energize Tea-Party voters and therefore is a net plus for November 2012 elections.
But he didn't. Instead, he chose to throw his lot in with the Court's liberal hacks.
He chose poorly.
