Judge Napolitano says that this is not an appropriate venue for "Executive Privilege" as it is intended solely to cover communications directly to and from the President and only on subjects of national security and defense.

That is what it is intended for, but, unfortunately, Clinton and Bush both extended it well beyond national security & defense. Clinton asserted it (unsuccessfully, in the end) regarding testimony on re: Lewinsky. Bush asserted it several times, including once regarding documents re: EPA documents regarding "global warming." So, Napolitano's right, but it may not matter.

It's looking exactly like Watergate. Nixon cited executive priviledge as well. The difference is that no one was murdered in Watergate.

Yes it is - but this FF stuff is easier, much easier to see a cover up. EP is only for communication between pres as one party but Holder has testified WH was NOT involved.

In addition to previous criminal allegations, perjury now has now cemented this as a criminal proceeding - for which there is NO EP.

This is turning out to be a chess match and Holder/Obama is losing.

Don’t they realize how stupid they look? If they were going to claim Executive Privilege, they should have done it from the beginning. Waiting for so long makes the whole thing look like a cover-up...which of course it is. How can they claim Executive Privilege for documents on this issue now, when they’ve already released some of the paperwork pertaining to it? They really don’t have a leg to stand on.
