Tampa, FL Floridas primary might not be over just yet.
The Newt Gingrich campaign is gearing up to challenge the results of the florida primary based on the Republican National Committees own rules which state that no contest can be winner take all prior to April 1, 2012. (See attached RNC memo.)
The Gingrich campaign plans to challenge Floridas winner take all status & demand proportional allocation of delegates.
Fox News has learned that Thursday, a Florida Gingrich campaign official will begin the process of trying to have the RNC rules enforced so that the Sunshine State delegates are proportionately allocated.
RNC Chairman Reince Priebus warned Florida Republican Party Chairman Lenny Curry of the violation in a December letter quoting the rule,
winner-take-all states cannot hold a primary or caucus before April 1, 2012.

I don’t know but SC didn’t change their date and Florida did. I believe that has something to do with it.

Gingrich, the former House speaker, has won at least 23 delegates of the 25 delegates at stake. Gingrich and Romney were still battling for the final two delegates.

Is SC safe from Mittens? How would that differ regarding this rule?
And if that loop hole does exist in FL could Newt be opening a can of worms that could end up with him sharing his SC wins with Mittens?

That rule was by the state party, not the national party. The rule for all the states as regards delegates is made by the national party.

I’d sure like to see Gingrich prevail here but I don’t hold much hope out for the RNC to enforce their own rules. After all, the “established Reps” are busy touting Marco Rubio for VP despite his apparent disqualifying problem vis-a-vi the pesky “natural born” clause. They don’t seem to interesting in abiding by rules or laws that are inconvenient.
Oh; silly me.
I am SURE the State Party is not in touch with the National Party when they are going to change the rules....

Katie, It depends on how the rule was written and if Roberts rules of Order were followed. Which rule came first etc.
If it said that all state that now have primaries or caucus... Then FL changed they may have a case...BUT that’s a matter of interpretation.

It it says that all primaries caucus before April 1...
Depends if state were named in the motion or if it was just a general statement...GO PEers aren’t as smart as they think they are....I don’t imagine Newt’s people would be filing the charges unless
In SC Newt got 23 and Willard got 2...not winner take all... no problem here...
I’m just worried that the elite will push the counterclaim to the 99 delegates, and that the RINO’s in the RNC will fall and award them to Florida, and that those will end up going to Romney. Conversley, if Newt wins, Newt could get some delegates. Or, it is possible that Florida may face another penalty and have their delegation cut down to 25 or fewer delegates.
If I was Newt, I would threaten to run third party if I lose and this matter is not fixed. The RNC has no right to acknowledge anything other than the rules. The rules were not changed, so Florida's delegates must be distributed proportionally.

SC is not a winner take all state. Fla is BUT remember that Fla deducted HALF the delegates before the election...I am waiting to see what happens on this or if it was some bizarre loophole that Romney already knew about...remember this man had run for president BEFORE and has the Roves, gop establishment and more on his side..I want to stand up and cheer! but I dont trust the rinos

NO IN Sc the winner of each county was given the delegate. Newt won all but a few counties. That is why he got most of the delegates.
