The Hill ^ | December 18, 2011 | Alexander Bolton

Posted on 12/18/2011 12:34:01 PM PST by EveningStar

GOP presidential frontrunner Newt Gingrich said Congress has the power to dispatch the Capitol Police or U.S. Marshals to apprehend a federal judge who renders a decision lawmakers broadly oppose...

Gingrich made his remarks during a Sunday appearance on CBS’s “Face the Nation” where he defended his position that the president has the power to eliminate federal courts to disempower judges who hand down decisions out of step with the rest of the nation...

Capital Police are ONLY for the U.S. Capital and no where else.

They do not get to go into another branch of Government to arrest people. Sorry but they are out of their jurisdiction.

Ever hear of Checks and Balances?

Someone warned, probably Madison, that the Judicial had no oversight and we would wind up with rogue judges. The difficulty is getting people to agree to get rid of a judge.

I remember an old book....54 Men and the Constitution....One of the Best books I ever read.

No real conservative would ever make such a statement. Wow let's arrest Judges we disagree with? Why stop at the Judicial Branch? How about arrest congressmen that disagree with the Executive Branch.

You do that and we will no longer have a President, but a King. If Obama did this, then you would go crazy. Be careful what you wish for.

Something tells me that the Framers of the Constitution did not envision this.

But isn’t that exactly what Newt is speaking of? Who the hell was this gay judge to over rule the majority of the people votes?

Who could say he’s not conservative with a straight face?

I can show you some things that don't exactly fall in line with the conservative movement.

1. Saying he melts when Bill Clinton is in his presence.
2. Saying the reason he was shagging his mistresses was b/c he loved his country so much.
3. Saying that Obama has the right to ignore a Supreme Court ruling.
4. Saying Obama has the right to abolish the 5th circuit court of appeals.
5. Praised the business model of Fannie/Freddie.
6. Has called for the federal government to have the power to force me to buy health insurance.
7. Held said view publicly until May 2011, which just happened to be the month that he stated he would declare his bid for the presidency.
8. Nancy Pelosi
9. Has called for "green" conservatism.
10. Has said he let the government shut down b/c Bill Clinton ignored him on an Air Force 1 flight, then had to sit back and watch said Clinton release a photo of Clinton talking to him on said flight.
10. Supported TARP.
11. Supported Medicare D passage.
12. Supported Cap/Trade.

While Constitutionally correct, one has to wonder why folks are alarmed by the concept.

It's Congress, not the POTUS who wields most power over the judiciary.

Then again, what about when the commies had a majority in the House and 60 votes in the Senate?

It's Constitutional and they would have re-made the judiciary.

And then they would have found it necessary to barricade themselves to protect their very lives.

So you think it’s okay for Capital Police to go outside their jurisdiction into another branch of government to arrest Judges they disagree with?

Are you nuts?

What Newt says in the video of the interview is absolutely correct.

Something tells me the Found Fathers, as Newt likes to quote, would be completely against this.

Actually as Newt points out, the Founding Fathers are the ones who established the Constitution (Methods and Procedures for governance). If you listen to the entire interview, he lays it out as the importance of the 3 branches to police each others actions and decisions.

His largest point being that for the last 60 years, the Judicial branch has been running roughshod over the will of the people with lawyering and elitism.

That’s what everybody was wondering and asking. I don’t know the status of that judges decision. Overturned?? Maybe someone from CA could tell us.

You’ll have to take that up with Newt. He says you can use them or the Marshall to enforce a subpoena. Judging by your previous posts, I’ll go with the former Speaker of the House on this one. LOL.

I guess that's why the wrote:
Article I, Section 8
The Congress shall have the Power . . .
To constitute Tribunals inferior to the supreme Court . . ."

And why they wrote:

"Article III, Section 1.
The judicial power of the United States, shall be vested in one Supreme Court, and in such inferior courts as the Congress may from time to time ordain and establish. The judges, both of the supreme and inferior courts, shall hold their offices during good behaviour, and shall, at stated times, receive for their services, a compensation, which shall not be diminished during their continuance in office.
Looks to me like they would very much agree with what Newt is saying . . . as they included it in the Constitution.

Oh okay so say the US Congress disagrees with the U.S Supreme Court.

Do you want congress to send Capital police to arrest Supreme Court Justices they disagree with?

Let me quote you back, “Better to remain silent and thought a fool, than to speak out and remove all doubt.”

The House can subpoena anyone they want to or haven’t you noticed that? If you fail to appear they will issue a warrant for your arrest.

You apparently refuse to watch the video. If you had, then you would know that you are being duped by a liberal media crafted headline that is pure dishonest spin.

This goes to show why the media craft headlines like this. As you have shown - they work.

It says NOTHING about arresting judges. Congress can impeach a federal judge, but they do not have the power to send Capital Police to arrest Judges they disagree with.
