I live in Uhrichsville. Within eight months time, my property was broken into three times.
After the second time, I had a security system installed.
At 2 a.m. on April 24, 2010, the alarm to the backyard barn went off. I armed myself and went to check it out. The barn door was wide open and a man was inside looking around with a flashlight. I yelled at him to come to me and he came at me with a tire iron in hand. He was less than 10 feet away when I fired a warning shot. He turned and ran; I fired more shots trying to get him to stop. At no time was I trying to hit him.
The police came, took the tire iron that he dropped and also took my gun. Its been almost two years, and I still cannot get my gun back.
No charges were ever filed. I saw a lawyer and was told it would cost me $400 to file papers with the court for return of the gun.
The gun was registered and I have a permit to carry. Im 68, never been in trouble. I fired in self-defense. Why are they keeping my gun?
Recently in New Philadelphia, a man fired three shots at a truck in town. The police took his gun and returned it the same day with a warning. What is going on in Uhrichsville?
Can someone please help me get my gun back?
Guns are for killing, not scaring. Warning shots are a bad idea.
If you go the small claims route you must realize that you will not get your gun back, only its cash value. Small claims has no authority to force the police to comply. They can only award money. So you must decide, is it the gun you want or the money it’s worth?
Don't carry a firearm (or 2 )if you don't intend to use them. Don't pull it out if you don't intend to shoot. 9 times out of 10, brandishing, or even worse, firing 'warning' shots, will get you more trouble.
For all the reasons which have already been posted to you. If you don’t have cause to use deadly force then you shouldn’t be pulling the trigger. If you pull the trigger it should be pointed at the threat, not the innocent neighbor.
Perhaps you can explain how a person who won’t stop at the sight of the gun but will suddenly change their mind at a warning shot?
I can think of a hundred situations where a warning shot into the air is a billion times safer than shooting at the perp... People behind the perp, he’s in your house, and your kids’ rooms are behind the perp, etc.
If warning shots are flat out illegal, that is definitely one reason never to fire a warning shot.

And, on giving warnings before engaging someone, “What are you trying to do? Turn it into a sporting event?”

The example I cited did NOT involve somebody with no intent to use a firearm, so I don’t know why you bring that up. My example involved somebody who did not want to shoot somebody unless he/she absolutely had to.
Plus you may end up needing that round.
They did this guy a favor based on the way he used his gun. Eventually he would have hurt someone.
I’ve only seen one good reason (the illegal warning shot reason). And, yes, I can imagine somebody seeing a gun and continuing to advance, and then being scared off by a warning shot. The idea that it could never happen is not very persuasive.

What do you call someone with a weapon who intends to do you harm?
I call my example somebody intent on doing harm who might be scared off by a warning shot.

Then you shouldn’t be armed, because you are dangerous to those around you and not to criminals.

And he might not, meanwhile your warning shot is going where? If it hurts someone you are now the criminal.
If you don’t have cause to use lethal force you should not be firing the weapon.
You apparently aren’t willing to learn. I hope you don’t hurt someone around you with your warning shots. Its apparent criminals are safe around you.
It’s apparent you can’t even come close to dealing with what I’ve written. Too bad, so sad.
